https://www.kxan.com/news/texas/sea...general-asks-for-handover-of-patient-records/ Is this overreach of authority? Does a state have the right to demand another entity located in another state to hand over documents or face penalties?
Of course not... They can certainly request anything they want, but once you put threats in there, I'd probably tell you to **** off too... Based on Washington law, they are not required to turn anything over for this "demand", so that should be the end of it. Not sure why they are suing?? Probably just to make even more public how truly horrendous the Texiban is these days??
I expect that the hospital would only need comply with Washington law, unless they've got some kind of business entity in Texas that could be penalized.
I just read this line from your SNIP "KXAN reached out to the OAG multiple times prior to publication; however, the agency never replied to our requests." That there is classic irony... Maybe KXAN should have threatened the OAG with a misdemeanor criminal charge for failing to respond??
Federal medical records law. HIPAA Title 1 covers insurance portability. HIPAA Title 2 covers personal privacy and security.
