    Sidney Powell presents her case to Federal Judge Timothy Batten in Atlanta federal court.

    Batten dismissed the case without hesitation. "No standing" by the plaintiffs, "late filing" etc



    At the very least, you can see this federal judge in Georgia is anxious to throw out Sidney Powell's voter fraud case, without good explanation. Powell's presentation was excellent, the judge's remarks were not. Dismissal for not having the case ready in the first few post-election days is wrong, as is defering the case to the the state court, which is controlled by the democrat machine. That feels complicit.

    He also rules that the plaintiffs don't have standing in the case, which seems impossible.

    This judge lastly says that the suit was brought too late, but without justifying that conclusion. The suit, he says, could have been filed months ago.

    That seems to me like declaring a crime before a crime takes place. Who would pay for a suit brought prior commission of a crime? He says he's certain that if he did not dismiss the case, he would be reversed on appeal.

    As you can see in his last remark, he stands by the fraud.

    Do you think three weeks was too long after the election for filing this suit?

    Given four years and millions of dollars totally wasted by democrats on Trump's impeachment that brought no results and weren't even expected to bring any results, what does such a piddling technicality that appears to merely reflect this judge's personal irritation. There was no date set by law. It seems invalid, irrelevant and unjustified.

    Come on, man, this is absurd.

    Trump will win.

    So let's say that six months from now it turns out that all the allegations are true, and Trump is the actual winner. Do you think that they will allow the Biden admin to continue so as to avoid national upheaval. Or will they reinstate Trump. If so, will the Biden admin bow out gracefully. Or will they have to be dragged out, kicking and screaming.

    The judge gave a legally sound explanation:
    "They ask the court to order the secretary of state to decertify the election results as if such a mechanism even exists, and I find that it does not."


    Batten did not rule on the merits of Powell's claim, which were made on behalf of a slate of would-be Trump electors in the Electoral College.


    Instead, the judge granted motions to dismiss the lawsuit on the grounds that the suit did not belong in federal court.


    Batten repeatedly suggested that Powell could have filed her lawsuit in state court, and he cited an federal appeals court ruling that "federal courts don't entertain post-election conduct, excuse me, contests about vote-counting misconduct."

    I've read her brief, and it's pretty bad. The "smoking gun" deposition that is critical to her case makes an unfounded speculation about Dominion that is ridiculous. I wrote about this in this thread. Worse still, Powell misrepresents its contents in her brief. The case has no legal merits whatsover, and I wouldn't be surprised if Powell faces sanctions for filing such worthless suits. As this article notes:

    Attorneys aren't required to have a rock-solid, definitely winnable case whenever they file a lawsuit. But they are required to conduct a preliminary investigation before going to court to ensure that a claim is credible, Gillers said. If Powell didn't do that, she could be at risk of sanctions.

    Correct.


    He went beyond stating that this was the wrong court for the action, which seems the first and only reason for dismissal. But no. He went on and discussed issues in the OP.

    You are obviously unfamiliar with the work and effort the Trump team has put into preparing this case.

    Trump will win.

    When at a later time they are brought to their senses that Trump has won the election, it will not matter to the office per se since Biden is vacant even when he's awake. No, they would not allow the Biden administration to continue, but would likely throw Biden and his entire crime syndicate in jail. Like I said, it matters little in the daily life of Americans or the economy.

    OK, but it's a legally correct reason.

    First of all, Powell is not part of Trump's team. Secondly, her brief was sloppy, filled with misspellings - suggesting it was hastily put together. I actually read a good bit of the brief, and as I said- both read and analyzed one of her most important depositions. She misrepresents the (already problematic( deposition in her brief. What's worse for her, and could get her sanctioned, is her failure to investigate the claims in the brief. They are easily falsified, and yet she presented them as factual accounts.

    There are literally thousands of sworn affidavits attesting to voter fraud, and there is much more. That is evidence.

    Or do you assume that everyone is as crooked as democrats?
