Through 4 years, one thing has become clear with President Biden: He has said one thing with regards to executive power and privilege, and he has done quite another when given the opportunity: Student loans, targeting parents, etc. He has done all of this, while laughably claiming to 'fight for democracy', a claim that I never took seriously and through his DOJ's own argument, we can now agree it's not a serious claim:

-By making the thrust of their argument that the government would suffer harms and injuries, the DOJ forgets: That's...THE...POINT.

In a democracy, it isn't just the checks and balances that level with the government. It's that in these inevitable checks and balances, there's a mechanical function that will inevitably damage any one of the components of the system. And that is by design.

That's why there's a bill of rights, to protect the people from said harms and injuries and even this isn't absolute: The state power of incarceration is obviously a harm and an injury.

So if the people can suffer harm and injury, the only way for it to be 'fair' and therefore, representative of a government then it too must suffer harms and injuries.

    The Biden Administration doesn't agree.

Not sure where you got the idea that executive action is not compatible with Democracy. If the executive action favors democracy, it's democratic. If it doesn't, it's anti-democratic.

Executive action to educate people promotes democracy (which Biden has done). Executive action to punish a private business for exercising their freedom of speech does not (DeSantis and Trump have done this)

To be fair, no administration ever wants harms and injuries while they're in command. But it would also be fair to say thus no administration actually wants to abide by democracy. They will only if we make them, and we dont because we think either the donkeys or the elephants are on our team...
