    I guess that's the response you get when you poll the uneducated.

    The Constitution says nothing about marriage therefore any action, for or against, taken by the federal government regarding marriage is unconstitutional.

    People think they can just throw the word "rights" around and attach it to just anything, and they're wrong.

    The Constitution doesn't allow gay marriage, it doesn't prevent gay marriage, it doesn't proclaim marriage is a right, it doesn't lay the groundwork for marriage laws, it says absolutely nothing about marriage.

    State issue, the end.


    ps. Just to get ahead of the pitch here because it always comes up ...the Full Faith and Credit Clause is about records and judgements of one State being valid in another ...again no mention of marriage.

    It is a states issue. But if your going to provide legal marriage then you must do so in a way that adheres to the constitution. Which means apply it equally to all who apply. There must be a compelling state interest to deny a right. And like it or not marriage has been firmly established as a fundamental right for all american citizens.

    So we reach the conclusion here that gay marriage is indeed going to be legalized in all fifty states. Why? Because all fifty states have legal marriage contracts.

    Well there is where you go wrong marriage isn't a right.

    Driving a car isn't a right. Voting isn't a right. Health care isn't a right.

    That word gets tossed around so much I don't even think people realize what it means anymore.

    Those things are privileges established by society and the majority gets to decide the conditions upon, and to whom, they will be dispensed.

    That's what The Constitution gives us, a structure for saying who gets to make the rules.

    And The Constitution is pretty damn clear that it doesn't want a centralize faceless federal government having the power to begin dictating every facet of life to the nation.

    I'm not advocating against gays marrying, I personally couldn't care less if two people I don't know are wed.

    But there is a larger problem here is the fact that we're handing our freedoms over to vipers that cloak themselves in good intentions, spamming words like "rights" and trying to con people into thinking that this is how the country was meant to operate.

    Its not really about gay marriage for me, its about shaking hands with tyrants because they're giving you what you want ...this time.

    But here's where your wrong. This isn't the government taking over. These are people going to the court and saying we are being treated unequally by their own government. The court then applies the constitution tot he situation and has come to the conclusion that gays are right, they are being treated unequally by their government.

    Also you may want to read section one of the fourteenth amendment.

    Kinda throws your whole argument out the window.

    Nah, it is just a sign of another crumbling empire. Might as well let teh gays be happy for a little while. Who knows what awaits them when the federal government isn't around to force their agenda on the people.

    Equally in that context means offer the same "product" to all, equally....which is currently done.

    It does NOT mean rewrite the "product" for each and every group that wishes it was something else, until they're happy with it and call it the same thing.

    Gays always had equal access to the same product, with the same restrictions as everyone else....they just wanted the definition rewritten because they thought it was icky.

    I say let them get married and be as miserable as straight couples. It is puzzling that homosexuals target Christians as their "oppressors" but not Muslims. Is it because they are afraid of the reaction from the Muslim community? Guess who would be the first to cut off your head if you are even thought of as gay? Political agenda, I think so.

    63% would say "I thought there were 10?"
    36% would say "Is that the Declaration of Independence?"

    No need. Americans overwhelmingly embrace and celebrate equal rights (as expressed in Brown vs Board of Education, Roe vs Wade, Reed vs Reed, etc.) without their having to parrot the precise verbiage. The 14th Amendment guarantees that ...

    "... No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

    ... and constitutes an admirable principle of American jurisprudence.

    It drives the alienated blatherskites ickyballooky, but is a hallmark of what it means to be American.

    I am unaware how "homosexuals", in general, "target" "Christians", in general, as their "oppressors."

    If you actually believe that to be the case, could you provide evidence of what you refer to?

    Perhaps, you hold that belief because so many Christian homosexuals feel they are entitled to equal rights under the laws of the jurisdictions in which they live, whereas so many Muslim homosexuals have no such rights?

    Homosexual Muslims demanding equality under sharia law is not an auspicious prospect for them, whereas advanced Western societies are far more amenable to progress - as has been and continues to be achieved.

    Seriously?? I bet if you did a quick internet search or forum search you would have your answer.

    I hold my beliefs because every time someone speaks out against gay marriage they are labeled as homophobes or right wing Christian nut bags. Have there been any Homosexual Muslim gay rights protests/parades that I missed?

    They parrot that though. It's not exclusive to Americans, very few people who aren't explicitly interested in politics (ie: the vast majority of society) have a minimal knowledge of the legal system they live under. I don't blame them, they have far more important things to be concerned with - but that doesn't make them knowledgeable.

    Sure, they vaguely support taglines such as equality, liberty, or free speech - but expecting them to know off the top of their head the legal argument the pro-gay marriage crowd make in favor of equal marriage rights is a bit much.

    If you asked Australians if we had an explicit constitutional right to free speech most would answer in the affirmative, but there exists no such thing. That they have a passion for free speech is a good thing, but it doesn't make free speech an explicit right.

    Wait a minute. There is a hell of a lot the Constitution doesn't cover. To say that just because it isn't in the Constitution, it unconstitutional is wrong. That is what the courts are for, especially the USSC.

    No, that's not true. Despite your "every time" generalization, Christians who support equality do not call those who do not "Christian nut bags" - and, certainly, the many are Muslims who oppose equality are not apt to be labeled "Christian nut bags," either.

    In which Islamic nation would you expect such open advocacy of equal rights? Wherever Sharia law applies, you really should not expect to see such an expression.

    Those disgruntled and alienated from America are apt to be critical of the familiarity of the average American with his constitutional rights to which all Americans are entitled, but the Founding Fathers instituted a Supreme Court to interpret and rule upon the purview of the document, just as it is expected to do concerning gender equality in marriage contracts by late June.

    Not everyone needs to applaud its ruling, but, as in the case of Loving v Virginia, it will then be settled law.

    In those nations where sharia law pertains, it will continue to be a very different matter, of course.

    I said nothing about whether the ruling was justified, just that it's too complicated for most to be able to say one way or the other, and so the poll in the OP is more a judge of people's attitudes toward gay marriage than their view on it's constitutional basis.
