What is the FISA Court, and how does it work?

    "The FISA Court is made of 11 judges who sit for seven-year terms. All members are also federal district judges, and are appointed by the Chief of the Supreme Court. Currently, that position is held by Republican Justice John Roberts.

    The court, in general terms, grants approval to requests regarding wiretapping, and other monitoring for foreign intelligence purposes. Sometimes the approvals lead to surveillance of Americans.

    The proposals have to be signed by a number of high-ranking officials in the FBI, DOJ, and Attorney Generals Office before they are presented to one of the judges, who rules on its legitimacy.

    One of the criticisms of the FISA Court is the small amount of proposals that are denied, as that number sits at less than 1 percent since the courts creation."

    My issue is simpler....What mechanism does a Judge on the secret court have to punish the government when the Judge discovers the feds have been lying or misleading him?

    Is there a mechanism?

    I believe if there was a way to hold someone or an agency in contempt, we would have already seen it happen. Instead we see and hear nothing. Even if a Judge resigns from the court in disgust, that act would be classified and we would never hear of it.

    CAN a Judge hold the agencies accountable for lying and if so what is the procedure?

    I believe the answer is most definitely yes, but, this Court does not seem to be exercising that, or any real skepticism at all.

    First, Department of Justice officials seeking a warrant do not need to show evidence that a crime has occurred or is about to happen. That sort of evidence, also known as probable cause, would be needed to obtain a typical search warrant in criminal court. Instead, officials only need to provide evidence that the target of surveillance is a foreign power or agent of a foreign power.

    Federal judges have tremendous powers.

    Several have stopped The Orange Man dead in his tracks already.

    I have no way of verifying that 1% claim, but if true why have a FISA court at all? Wouldn't it be cheaper to not have that court? I mean, the outcome is going to be essentially the same. No?

    If the FISA judge who signed the warrant to spy on a member of the Trump campaign was “duped” into doing it, he can and should jail the culprits for contempt – Rep. Louie Gohmert (R-Texas) said Wednesday.

    The issuing judge was either “duped” – or complicit in signing the unjustified surveillance warrant:

    “One of two things – either the judge was duped with false information with the lies into signing a warrant or the judge is just so worthless he was part of all this and didn't care if he didn't have the facts.”

    “As a former judge, I could tell you and I was talking to John Carter, a former district judge, if somebody lied to us in court and especially a lawyer, we would be after their license to practice law. And I find out –that if you put one lawyer in jail one time for contempt, then the lawyers work really well with you after that and they are very honest and straightforward.”

    If the judge was, indeed, manipulated he could – and should – immediately throw those responsible into jail for contempt, Rep. Gohmert concluded:

    “Either way, the judge should be livid in the fact that these guys didn’t go to jail for contempt.

    “And, there are a couple kinds of contempt. You can have a contempt where a judge has to have a hearing, sort out the facts.

    “But, if a fraud is presented to the court and the court’s manipulated, you don’t have to have a hearing – you can just order them in contempt for six months in jail and these people should be in jail for what they did.”

    Now THERE is a judge you can trust to protect you against illegal government spying.

    I am more interested in holding folk accountable than in changing the law to make the next generation of perps accountable

    AMEN! All they seem to do is provide a fig leaf to 4th amendment abuse by our fine government.

    The court does not hold individuals accountable. That is up to the DOJ.

    The FISA court is in place to make you feel like your privacy rights are protected while the federal government secretly surveils whomever and whatever it wishes, for whatever reason it can dream up.

    It's similar to the Hyde Amendment being in place to make you feel like you're not paying for your neighbor's abortion.

    FISA courts do not make someone guilty, actually put someone in jail or say an American is a criminal or manufacture evidence!

    FISA simply allows our intelligence and FBI to collect information

    After 50 years of Republicans crying about criminals getting away with their crimes because of some "technicality", Republicans and Bush now have elevated actually committing treason and other high crimes to the top of the reason of why Republicans say they say they should be let go scott free for selling out America!

    There is no Badge of Honor because Trump and these Republicans can escape jail because of technicalities like these. They ARE betraying our country.

    Page was on the Clinton Transition team, he may be a Republican, but clearly he was also highly regarded by the Clinton's, at least at one time. If he has committed crimes, why hasn't he been charged?
