When does a conceived baby become a person? When does a white person become black? When does a man become a woman? The first question has an answer, but it might change soon. Harry Blackmun, writing Roe versus Wade, decided that an unborn baby has no Constitutional rights because it is not a person until birth. Noting that the country and states have an interest in whether babies are born or not, he drew lines at the 3 and 6 month marks. That was arbitrary and minimally based on biology. Recently some states passed laws that let a woman tell the doctor to kill the baby after birth. If they hold up, the definition of person changes. The second question has an answer. States used to discriminate based on color. In an effort to restrict as many people as possible, they decided one drop of black blood was enough to restrict freedoms. So a person of mixed ancestry might change color 10 times on a cross country trip. Also the census, with no consequences, lets people identify themselves as they wish. A Hispanic was stuck with other or whichever color was closest. Then the US added Hispanic, allowing them to call themselves that if it was closest. In the last census you could choose more than one, allowing white Hispanics, black Hispanics and Asian Hispanics. On surveys everyone has to answer about Hispanic origin, then choose a color. I was with a Hispanic Hispanic who didn't understand why she had to say it twice once. Native American tribes and some social clubs are happy anyone wants to join and offer very minimal qualifications, still they might exclude some people by small margins. Soon the third question will need an official answer and the Supreme Court is more likely than Congress to make the definition. Right now independent organizations have to make their decisions. Does a man become a woman when he says he's a woman, when he starts the treatments, when he finishes the treatments or never?
