Which Justices Will Vote Aginst the Constitutionality of Obamacare? In this poll I ask all of you which justices will vote against the Affordable Care Act. Dont take the poll too literally. In other words, with respect to the poll lets not get in to the weeds of whether a portion of the Bill will be struck down or the whole thing. Assume a portion of the Bill being struck down is a vote against the act itself as, lets face it, Obamacare cannot function without the individual mandate. Furthermore, I have posted two debates which include some of today’s greatest legal minds, both from the left and the right. For all of you who are curious of how the debates in the Supreme Court will be argued, you can be rest assured that these are the very same arguments that will be presented before the court, and then some. Scalia has already ruled the the ACA is constitutional. Yes, it was even that obvious to him. Okay, it wasn't the ACA, but it was the same thing. In Gonzales vs. Raich, Scalia ruled that the Commerce Clause gives congress the authority to regulate marijuana growth and sales, even if it never crosses state lines. Now, it will be hard to Scalia to do an about-face and reject his own precedent, but I wouldn't put it past him, given Scalia has amply demonstrated that primarily partisanship drives him, not the Constitution. Thank goodness we have some honest liberal judges to balance him out. What do you all think? Do you support Scalia's legal reasoning in Gonzales vs. Raich? Will Scalia reverse his own majority opinion in the name of rank partisanship?
Criminalizing the act of NOT buying and NOT smoking pot are we? The opposite of prohibition perhaps? I did not know that Gonzales vs. Raich forced people to buy marijuana. If so, I am guilty of not purchasing and smoking weed. Shhhhhh, dont tell anyone I'm clean.
