    Vote fraud is actually rather common. Elections have been voided because of it. For instance, thousands of dead have voted just in New York.

    “When the Poughkeepsie Journal in New York did a 2006 analysis of how names of deceased people were still on New York's official list of registered voters, it conducted the assessment by matching "the names, dates of birth and ZIP codes of all listed voters in New York's database of 11.7 million voter registration records against the same information in the Social Security Administration's "Death Master File," a database of 77 million records of deaths dating to 1937."     Yes, I am sure there were many lawyers involved in the FBI investigations. Many FBI agents are lawyers, but there is nothing like an active professional prosecutor who is focused on whether he can build a case that can be won before a jury. I wold have expected one to have been involved.

    Do you think Comey's assertion that there was no criminal intent is credible or even relevant? Isn't the Espionage Act a strict liability statute?

    It is double voting which, if I understand correctly, is quite rare - likely due to having to use your real name/info :D

    I am beginning to think you are referring to one decision and I am referring to another. yes I think it credible in both instances. Practically speaking as opposed to legally, it is always relevant regardless of the statute. As long as human being make decisions based on someone else's conduct, a perception of intent will always be inherently relevant. It sure will be relevant when it comes time to negotiate a plea agreement or at a sentencing hearing.

    2600 dead people voting in one state is not "quite rare". No one seems to know exactly how common it is.

    That is rare.... And usually it only happens because the defendant did initially talk to investigators.

    If you don't say anything then there would be no reason to take the stand.

    You just don't talk...

    To talk about "the law" with respect to this election is foolish. The Democrats have been exposed, their election fraud has been detailed from their own mouths, they have been dedicated to election fraud for decades.

    This election is a scam, a fraud, in any lawful nation it would be declared null and we would start over and implement real election reform.

    You misconstrue the notion of legal intent. First I want to see the evidence of dementia or delusions or mental incompetence that might convince me that there was no intent to double vote and thus commit the fraud. I don't much care if she thought is was a 'good idea' or the right thing to do. I care if she can credibly claim she did not intend to vote twice or that she could reasonably claim she did not think it would amount to a 'voter fraud' on her part.

    I am not interested in jailing for fining anyone who thought that the first ballot she cast was for FDR and the second was for her son, Clyde.

    Dead people voting is not the same as double voting.
    Double voting is when a real live person votes twice (using the same, real name).

    There is no way of knowing how often double voting occurs, but we do know that it happens - a lot.

    “More than 35,000 cases of voters with the same names and birth dates voting in multiple states in 2012 were also identified, although others caution more investigation is necessary to determine whether coincidence, poll worker error or other explanations are behind the duplicate entries.” Politico, State legislators are pushing for a criminal investigation.

    voting fraud is so insignificant and/or never happens we won't have to worry about it, according to democrats and liberals on this website... so why even ask this question?

    its just fascinating how so many people who say this isn't a problem, suddenly are declaring it a problem... just like they went from dismissing rigged elections to screaming rigged elections... although to be more accurate, they screamed rigged because of Bernie, then not rigged to support Hillary, now saying rigged to support Hillary... ya'll are just a funny bunch... (sticks finger up in air to see which way the wind is blowing today)...

    P.S. and for those who want to distort voter fraud and reinterpret what republicans/conservatives have been saying... what they HAVE been saying is they are worried about people who are not allowed to by law voting, not folks who easily get caught when they double vote with their own names, we're worried about the ones who are illegally voting and are not allowed to vote by law because they are not citizens, yet MILLIONS are being added automatically as registered voters... the only thing stopping those folks from voting, is their own honesty, and we have little to no means to test and validate this before the damage is already done and someone is elected president... thats what conservatives have been complaining about... thats the voter fraud they want ID's and birth certificates for... you know like the "REAL ID" was supposed to have provided us in 2016... this year was supposed to be the year EVERY american who flies or does anything, was supposed to have a new license/state ID that was linked to their birth certificate to ensure they are not just who they say they are, but a legal citizen with certain rights others don't get... but that has once again been postponed and delayed indefinitely because many states issued the ID's without confirming birth certificates or marking the licenses/state ID with the correct markings to indicate they were not validated as citizens by birth certificate or otherwise...

    That's a lame excuse for breaking the law because it would be taking the law into your own hands and possibly bring down a stiffer punishment. I'd advise her to apologize, plead guilty, and take her lumps. She did wrong.

    Criminal defense lawyers for Hillary Clinton would certainly rate "Dementia, or delusions or mental incompetence" as very good arguments that she did not have the the 'guilty mind' required for a criminal conviction even though the Espionage Act is apparently a strict liability statute.

    “The standard common law test of criminal liability is expressed in the Latin phrase actus reus non facit reum nisi mens sit rea, i.e. "the act is not culpable unless the mind is guilty". In jurisdictions with due process, there must be both actus reus ("guilty act") and mens rea for a defendant to be guilty of a crime (see concurrence).     Correct. There will be massive vote fraud in this election. WikiLeaks has proved that the entire process has been rigged for Clinton from the start by both parties and the MSM. Will that be enough to stop the Trump juggernaut? We are about to find out.

    I suspect that her lawyer has advised her to do just that. After all, she is not part of the corrupt ruling political class - she is not Hillary Clinton.

    like I originally stated months and months ago... if Clinton and Trump become the nominees its going to be an absolute blowout by one side, much like Reagan was the landslide of electoral in all but one or two states if I recall? the problem is, I have absolutely no clue which one is going to be the landslide, the polls went from a 12 point lead back to 1 point, but I don't think even thats close to being accurate, I think its going to be double digits for one of them at the end of the day, I just don't know who... there are just so many silent voices on both sides, not a single poll is going to get this one right...

    although I will say, I was shocked to see Johnson drop, I honestly thought this might be the first time we see a 3rd party candidate hold on to their votes before election day, granted, according to what I said, those polls are grossly wrong, so he may still get his 10% or more of the vote instead of the now 3% I think he's predicted to get? all bets are off on this one, I'm picking up my chips and went home to wait until after before I start playing the craps table again... the dice are bad or something... lol...

    The Republican/Democrat establishment opponents of Trump and their MSM hacks are all screaming like banshees in a bonfire.

    and I agree he likely has a larger potential "silent voter count", but don't dismiss the liberals going silent submarine also... the group I have lunch with almost daily because thats what old guys do when their wives don't want to hear politics anymore, and folks we long have known to be loud mouths for their support, are going silent and running away from voicing opinions this election... both sides are clearly disgusted by the choices, and it seems those who want to admit they support someone in public, is shrinking...

    thats why I think this is going to be another Reagan sweep one way or the other... its going to happen, just no clue for who...

    She must have hit her head and got confused and thought she liked trump the best. Then she forgot she voted and went and voted again. Or, she thought you had to fraud them damned democrats in order to fair and square given we know democratic operatives now use cars to bring in illegal voters instead of buses as they once did.

    Regardless, throw the book at this woman for voter fraud. Justice is supposed to be blind even if she appears she had her blindfold ripped off by the Obama justice dept. I guess if you can find the Lady you could look to make sure. But she seems to have left America and is now whereabouts unknown.

    you haven't a clue what constitutes legal intent. LOL. By your definition a murderer with the intent to kill, but thinks its a moral or proper act to do so, lacks requisite intent. It does not mean squat what she thinks about the integrity of elections. It matters that she knows she is voting twice when she is only supposed to do it once and does it anyway. I was going to talk more about the section of the espionage act and intent, but not with you. You would not get it anyway.
