If an Article V Convention was called to amend or replace our Constitution, what do you want to include? I'm not interested in being critiqued or critiquing others. I'll list my suggestions and you can list yours, even if they are completely opposite of mine. I'm kind of curious where everybody stands and what their ideas are. You can't always tell what somebody thinks because the people they support don't always agree with them 100%. Here are my ideas. Amendment: Term limits in both houses of Congress so that nobody may serve in either house of Congress for more than 12 years. 12 in the House and then 12 in the Senate is the maximum. Amendment: Anchor babies are not allowed. In order to automatically become a citizen of the US at birth, one must have at least one parent be a US citizen at the time of birth. If the US citizen parent dies before birth, then the child can choose where they live when they become a legal adult and will stay with the surviving parent until that time in the country of their parent. The surviving parent may apply for US citizenship, but no guarantees are made of acceptance. Amendment: The Federal government may not own more than 2% of the land in any state of the United States. Any land in excess of 2% will be sold within 5 years of ratification of this amendment. The Feds may petition the state for an exception and may lease excess land from a state and this must be approved by the state legislature. Amendment: Tax reform. The Federal government is prohibited from directly taxing citizens of a state. The Federal government will levy taxes on the states based on the population of each state. States may tax how they see fit to make these tax payments. Amendment: Alternate tax reform. The Federal government shall abolish the individual income tax and begin a 10% sales tax with exemptions only on groceries and medical care and supplies. This will be accompanied by a mandatory balanced budget. Amendment: This is to reaffirm the 10th Amendment. Any Federal agency must be specifically authorized in the Constitution or it's Amendments. The General Welfare Clause is no longer available for abuse. The Federal government shall provide no direct services to individual citizens of the states unless those citizens are employees of the Federal government. Amendment: The 2nd Amendment shall be rewritten to read as follows. "The right of the people to keep and bear arms shall not be infringed without due process approved individually by a jury of their peers. State and Federal governments may limit the carrying of weapons in the following locations. (courts, police stations, jails, prisons, and any government banking institution that provides armed security) I look forward to your ideas. Edit: I forgot to deal with Social Security, but I'm going to bed right now.
I disagree with your anchor baby amendment. It should be written "One parent has to be a U.S. citizen or permanent resident alien at the time of birth." I also think that all spouses of U.S. citizens should automatically get permanent resident alien status (unless they have been shown to be violent criminals in their home country). I
No, i will never support changing the constitution. I would support enforcing it, you know, a change of pace....
My suggestions: 1) Within a time limit any supreme court decision can be overturned by 60% of state legislatures or 3/4 of Congress. 2) Revert back to Senators being appointed by state legislatures 3) Clarify the commerce clause; A) not plenary power to regulate and control economic activity; B) removes inappropriate restrictions on trade among the states; C) cannot regulate any intrastate activity. 4) All bills put in the public record unchanged for 30 days before becoming law. (override by 2/3 congress vote) 5) Within a time limit 60% of the state legislatures can override a federal statute in total, with no appeal by congress, executive branch, or courts. 6) A valid photographic ID is a requisite for voting for any federal office.
BTW, An Article V convention can make amendments but can't and won't replace the entire constitution.
