The foundation of the charges are things Trump said. He is being persecuted for his right to speak freely in public. You know it. I know it. Smith knows it. Smith doesn't have the best track record, does he??

Your reply forces me to be redundant on the point that Smith goes out of his way in recognizing much of what Trump did in resisting the reality of his defeat was within his rights. But as the example of yelling fire in a theater shows there are limits to free speech. Clearly Don went beyond speech in putting together the fake elector scheme, which is central to the indictment.
You really should read the indictment.
