ABORTION PILL RULING: Judge SUSPENDS FDA Approval of Mifepristone

    Here we go again-- on the Right Overreach Ride. One of the pharmacy drugs used for more than half of all abortions, mifepristone, has had its FDA approval invalidated by the Republican ringer judge in Amarillo, TX, Matthew Kacsmaryk. If this order goes into effect, it will no longer be available to anyone in the country. The judge has put a stay on his order for 7 days, before it goes into effect, to give the government the chance to appeal. But, the appeals court would be the most ideologically radical Right wing, 5th District. It would be up to them, whether to extend the judge's stay while they hear the case-- as would be expected, in normal times-- or let it go into effect, as the SCOTUS had allowed Texas's controversial law, allowing civil prosecution of residents who have abortions, remain in place, while in the appeals process.

    In an unprecedented move, U.S. District Judge Matthew Kacsmaryk on Friday suspended the Food and Drug Administration's longtime approval of key abortion pill mifepristone, but gave the government a week to appeal his decision that could throw access to medication abortions into question nationwide.

    The FDA approved mifepristone more than 20 years ago to be used in combination with a second drug, misoprostol, to terminate pregnancies at up to 10 weeks. Over half of U.S. abortions are done by medication abortion, according to the Guttmacher Institute, a research group that supports abortion rights. The pills have become increasingly significant in the fights over abortion access that have ensued since Roe v. Wade was overturned.

    What thickens the plot, is that another court, in D.C., hearing a different case, but on this same drug, today issued their own, opposite ruling, that the FDA has no authority to make any changes in this drug's approval; mifepristone has proven itself extremely safe, over 23 years of use, in the U.S. What this guarantees, is that this case will end up in a SCOTUS showdown. In fact, the government may take a page out of the playbook that the Right used, to speedily bump its abortion case to the Supreme Court-- basically, just asking the appeals court to rule against it, so it can be appealed, further up the chain.
    It should be noted that this judge Kacsmaryk, had come from being a partner in a Right wing law firm, which had specialized in advancing these "conservative" types of legal objectives, though the federal court system.

    To be fair, these are private citizen Republicans, who'd brought the case; and the Republican judge, is not an elected official, though he had been installed by Trump, for precisely this sort of dependable subservience to the hard right agenda. IOW, Republican politicians had certainly set the table, but did not initiate the serving of this particular course.



    P.S.-- CORRECTION, For All: the other ruling, saying that the FDA is not allowed to pull approval from mifepristone, which came an hour after Kacsmaryk's, was from Washington State, not Washington, D.C.

Contraception is widely used and largely uncontroversial, and the bill says nothing about abortion, but a whopping 195 House Republicans voted against it anyway.

    Unsurprisingly, poll after poll has shown that a vast majority of voters support the fundamental right to access contraception and other basics of reproductive health. In 2019, about 92 percent of Gallup respondents said the use of birth control is “morally acceptable.” However, more recent surveys and midterm election results suggest that many voters did not know House Republicans voted against a bill to codify contraceptive rights, and when voters did hear about it, Republicans with extreme views faced headwinds among women and swing voters.

    That is NOT the way it is being depicted. I have heard no one mention the sequence of the rulings, being relevant. The appeal of Judge Kacsmaryk's ruling will be heard by the conservative 5th District Court, which will have the power to either stay that order, or allow it to go into effect. The fact that it contradicts the Washington judge's ruling, only means that the FDA will be damned, either way, so will be the reason that the SCOTUS will need to sort this out. It would be startling, if they allowed Judge K's order to go into effect, prior to the High Court ruling-- but no longer an unbelievable possibility.

    That is also a fair point-- that even if it wasn't elected Republicans pulling the strings at this moment, the ones who were, the big donors to Republican politicians, are the ones who ultimately call the tune, and 'publican pols have faithfully sung in the choir, after these types of actions (and sometimes even sign on, with Amicus briefs).

    Agreed. Those assault weapons literally blowing kids into millions of pieces is horrible. I've seen it myself how young women having their arms and legs cut off and made into sausage on a sunny Saturday afternoon. I couldn't believe the Republicans could be so evil.

    Honestly though, the GOP needs to reign in these idiots or they are going to hand the whole country over to the loony left.

    When our federal legislators set aside situations which arise in our society and spend their efforts and time in raising campaign funds and opposing the process of compromise, the result is legislation from the bench. When that in turn is driven by ideological considerations, we end up with the decisions noted above.

    Sooner or later, someone is going to realize that interstate commerce is also involved and another layer of suits will follow. If nothing else, we're keeping lawyers off the bread lines.

Let's not (normal America) underestimate them again because they have KEY judges in place all down the line in control of most cases brought in the future.
