A court can definitely determine that someone has committed fraud without determining whether that person is guilty of the crime of fraud. Happens all the time.

I don’t consider myself a lefty, but anyway I respect the Constitution and want it applied. It is MAGA that wants to ignore it.

I haven't read through this whole thread so it's a good probability that what I'm going to write has already been mentioned but there are several glaring errors in the Colorado decision.

The first and most egregious error is for the court to have focused on Section 3 of the 14th Amendment to the exclusion of the other 4 sections and especially section 5. Section 5 SPECIFICALLY vests Congress, not the states, with the power to enforce the provisions of the Amendment. The court, if they stopped for one second to consider the Amendment as a whole, should have kicked this whole case out.

The second issue is that the court went to the dictionary to define "insurrection". That was unnecessary and, perhaps intentionally, divested the term from the context in which it was used. "Insurrection" is used in both sections 3 and 4 of the Amendment. In both sections the clear intent was to indicate the Civil War. That is especially the case in section 4 where they are talking about how to pay for the war. Furthermore, "Rebellion", a term used in conjunction with "insurrection" in sections 3 and 4, is also used in section 2 and, again, CLEARLY refers to the Civil War.

As used in the 14th Amendment the term "insurrection" OBVIOUSLY means a significant military action against the government, not some 4 hour riot.

I'll leave the asinine arguments related to "engaged in" and Brandenberg alone but the "analysis" related to those matters was stunning.

It's not a matter of figuring anything out. The Colorado Supreme Court isn't based on "criminality", which the 14th Amendment does NOT require.

So now federal judges stating someone is acquitted of insurrection, doesn't mean they are acquitted on insurrection because all they can do is remove him from office.
