    The law was applied in an unintended manner to GET TRUMP. This is not justice where the law is applied equally to all. If it is the intent of Letitia to indeed apply this law universally and equally who is next to be indicted for so called fraud on loan applications. No one should be happy about this

    Usually, when a valid legal argument is made, its proponent relies upon some language in the statute and maybe a case or two interpreting the language in their favor. A legitimate legal argument is not “uh, it’s supposed to be consumer protection only “ when the language doesn’t support that argument, and similarly, a valid argument doesn’t rely on screams of unfairness when it does not even exist.

    To put it simply, you’re way off base.

    And an accurate defense. Valuations are subjective. It is the fiduciary responsibility of DB to determine valuation, risk, and appropriate interest rate. This they did. The loan was granted and repaid. No victims. No damages.

    Laws are not meant to be broken.

    But you understand that the law exists because the bank will be on the hook when these valuations are incorrect right ?

    And these “valuations” are built by the company requesting the loan. No loans would ever happen if the banks had to do all of the due-diligence on valuations. This isnt like getting a car loan where you have to show your W2 and other legal financial documents, BUT, if you read the legalize on your next loan, it clearly states that if you lie on your application you can be held financially and legally liable for those lies…

    So explain why a business should be exempt from that if they lie on document THEY create ?

    They never said no one was defrauded. And good luck with your argument that it should be legal to shoot at people as long as you miss -- which, yes, is what you are arguing. You are also arguing drunk driving should be legal as long as you don't hit anyone.

    It is the fiduciary responsibility of the lending organization to determine valuation and risk. That is always the case. In this case DB did due diligence. They granted the loan at an appropriate interest rate, the loan was repaid on time with interest.
