    I agree with this, and would add that we shouldn't be racist about it, excluding anyone by race who needs the help or including anyone by race who does not, which is part of what AA does.

    I thought the goal was to ensure that entrances to higher learning were based on Merit, vs non-academic characteristics?

    The entire Civil Rights movement, and it's subsequent laws, was about eliminating racial discrimination. I don't understand where you are getting "merit" from in this. The issue is about racial discrimination.

    Affirmative action was an imperfect remedy to racial discrimination. And attempt to balance the playing field by taking a small step to deal with decades of discriminatory practices. Now that it has been struck down should college admissions offices be forced to stop giving preferential treatment to legacy candidates for admission based on a parent's attendance in the school?

    How is the left so out of touch with the rest of the world? AA promotes racism, it does nothing to combat it. By putting race-based quotas on anything, it means that we are actually losing out on those who are talented, under the idea that because they are a 'preferred demographic', they will somehow land on their feet.

    AA was the last true law of segregation, against American interests and always against the American People. Today, we remove the vestige of racism completely from our public square, and Liberals will have to live with it.

    Your comprehension is lacking. "Based on merit" is referring to affirmative action as you see it anyway which is why you made the comment. My rebuttal is that if "based on merit" was always the case AA wouldn't have ever been needed.

    From the majority. “The student must be treated based on his or her experiences as an individual — not on the basis of race. Many universities have for too long done just the opposite. And in doing so, they have concluded, wrongly, that the touchstone of an individual’s identity is not challenges bested, skills built, or lessons learned but the color of their skin. Our constitutional history does not tolerate that choice.” But our society has for decades upon decades, leaving qualified black people without equal treatment.

    Unfortunately, the conservatives, just as they did in the decision to gut the VRA, show willful ignorance by pretending racial discrimination against blacks no longer exists. Repub controlled states said "thank you very much" and without hesitation enacted discriminatory voting laws in direct contradiction to the premise of the majority's ruling.

    It's worth pointing out the candidates being advantaged by AA were not unqualified for admission.
