You are correct, it's not that complicated. Once they cross the border anywhere but a border crossing, they are ineligible for asylum. Therefore, they are illegal.

The Biden administration (and your arguement) are engaging in and defending the portions of the law that allow fence jumpers to claim asylum.

I dont, as an example, believe the intention of the asylum provisions were intended to give anybody chasing the American Dream and excuse to come into the country without following the current processes.

I belive the asylum provisions were intended to give safe haven to innocent people being persecuted in a number of different ways justifying their escape.

Allowing every fence jumper the claim of asylum is allows for the complete invalidating of the immigration and naturalization process. There is simply no point to that policy anymore if the asylum provision is molested they way you defend it.

 

The Biden admin is following the law. And a claim doesn’t let them stay forever. It’s a temporary protection. Likely loved by those who rely on migrant labor.

Entering and remaining in the US without proper authorization is a crime. Someone who commits a crime is by the simplest of definitions, a criminal.

 

I was discussing gang membership like criminality, not paperwork criminality not hurting a fly.

 

What I can't understand is why wouldn't those DACA recipients want to return to their home country to be reunited with their parents.
Or are the parents still here in the US, illegally?
At least nobody will be accused of breaking up families, they all get to go home together.
