This is the technology that you want to FORCE American companies to give to foreign nationals? PS. The person was not hired because he was not a U.S. citizen or lawful permanent resident. It said that right in the referenced article.

I realize it's been 4 yrs since our gov't actually followed the laws and the constitution of the USA, but don't be mad because we are once again being a law and order nation.

Then this is a non story and the prob will simply be closed. I own two very small businesses and we have been involved in employment probes three times — all resolved with no recourse to us.
As big as these companies are they likely have entire departments to deal with these types of issues

False, they do not have to hire them but they cannot refuse to hire them due to the protected qualification.
Anyone is free to file a grievance with the state or federal government.

I don’t know if it is illegal to ask but it is illegal to make a determination based on it. It is a protected qualification like sex, ethnicity or handicap.

 

So the DOJ is investigating Elon Musk because he didn’t hire this guy citing preferential treatment to American citizens. This is not a right wing propaganda machine. It’s a story and we should all wonder how we got here.

.......How DARE they call this the immigration 'reform and control' act, it's more like the 'Sellout the US Act'. At this point, there's no privileges really to being an American citizen. Like, what are we paying our tax dollars for? They can't sustain our livelihoods while shutting down businesses in response to the coronavirus. There are tons of privileges to being an American citizen, we have medical bankruptcy for instance.
Where do our taxpayer dollars go? A huge percent go to the military, care for veterans injured in the military, our bloated and ineffective government and our elderly. We also give huge sums back to multinational corporations and the super wealthy so those are great causes. The rest of us, we have the highest combined taxes in the world and get very little back for it.

As for America being “laughed at, ridiculed and mocked by our European contemporaries” — we are.

I would like to call attention to a particular part of that law that will answer some questions/statements posed in this thread.

Seems to me Elon has an easy out here. Simply provide the credentials of the person that was hired in place of the claimant and the reasoning that they were hired instead of the immigrant.

And frankly I find the reasoning that the IER gave for requesting the information that they have to be a fishing expedition. Particularly in light of the part of the law that I quoted. Basically they want to determine if SpaceX has "disproportionately" discriminated against immigrants. Well, hate to break it to them but the law allows for such to happen. Requesting the information that they have has nothing to do with the claimant specifically. Which is what they should be working on. Not trying to dig up more dirt.

I would imagine that if the IER had been reasonable and simply requested the resume and reasoning that they hired the employee that took the job the immigrant was applying for and compared it to that of the immigrant then Musk would have complied. As it was....well... no need to repeat myself.
