His state of mind afterwards was exactly the same. He expressed no remorse, and was even boastful.

That could be a convenient excuse for any number of murders. The following is from a lawyer and self defense expert, a good article about this case:

Any hope Greer might have had for making such a “reasonable under the heat of the circumstances” argument, however, is substantively damaged by his own recounting of the deliberate nature of his use of deadly force against a fleeing, and pleading, target.

it could be a reason used for many self defense cases where the victim was beat in the head before doing something irrational in his or her self defense

if you don't want someone to act irrationally towards you, don't beat them in the head.....

I'm not defending their crime, but there is a reason vigilante justice is illegal. She got the death penalty for alleged assault and attempted burglary, That's a little harsh.

this was not vigilante justice, they beat him, he was a victim defending himself

I agree it was harsh and that he was not thinking clearly after the beating to the head.... the beating to the head gives him more leeway in this instance imo as he was not totally responsible for his actions

the dead women and her boyfriend are the ones that are alleged to have killed her, she committed suicide that nite and her boyfriend helped her do it

Can I ask where in any report it states "they beat him in the head", because all the reports I have seen mention nothing about head injuries, nor can any obvious head injuries be seen in the video interview he gave after the event . .the interview where he admitted pursuing the woman into a public alley, shooting her once and then executing her.

Completely and utterly wrong, he was not defending himself, the actual attack was over the people who committed the attack were fleeing from the scene and the woman was not on his property when he executed her. Self-defence is only relevant prior to an attack IF the person truly feels their life is in danger or when the attack is occurring.

Had the man shot her while on his property or during the assault then a plea of self-defence would be correct, he did neither of these things and as such under Federal and California law what he did is a revenge killing. You cannot seek out and kill someone for a crime after the fact.

furthermore in all the reports I have seen and read there is not a single mention of this "beat about the head" you allude to, this man was of sound enough mind after treatment to give a video interview where he basically admitted he shot her as a message to her boyfriend not to come back .. that is not self-defence.

    http://www.cnn.com/2014/07/25/justice/california-slain-burglar-pregnant/

"Police say the couple beat and threw the elderly man to the ground, causing injuries, which included a broken collarbone, cuts and bruises."

I would used the "Battered person syndrome" defense, he thought if he did not shoot his abuser would attack him at a later date and time

if I were him would stall the case like crazy too, if he dies before the case ends or is appealed, he is by default not guilty in the eyes of the law

They committed an alleged attempted burglary, and alleged assault and battery.

His behavior was not consistent with "battered person syndrome." Did you read the link I provided? His state of mind was revenge, and "sending a message," that's obvious from his own statements.

It was not self defense, it was an unnecessary killing to "send a message." That makes him a cold blooded killer. Maybe you're not the best judge of character.

yeah, and he is only "alleged" to have killed the girl then too

sure it was, he was battered, they did this two times prior, he thought they would come back again....

ya rob the elderly and you might get killed, fact of life

What do we have besides his word that his injuries were inflicted by the burglars?

The logical thing to do would have been to secure his house, wouldn't it?

I understand they committed a despicable act. But he did too, cold blooded murder.

and then we get back to that thing were they also had the first choice. They could have stayed home and NOT robbed anyone. Then she would be alive, and the authorities would not have arrested son and mom and you would still be griping about guns.

You are the only one who has brought up gun rights, not just once, but repeatedly, which leads me to believe you are more concerned about protecting gun rights than you are about seeing the law upheld.

and here you are wanting to hang a victim. He turned the tables on his assailants, and you want him to hang for it.
He's an 80 year old man.
These animals tried to beat him to death after robbing him. I'd say he had every Right to go after them.
I wonder if you know how much effort it took to get off the ground after an ass kicking like that and go after them.
I applaud this man. He'll never see a day in court, and if he does, they wont find him guilty.

"The ass kicking" according to whom? When asked in the video what happened to his shoulder, he said "that's where I fell." The only information we have is what he has told the media, some of it contradictory, and that's what you are basing your judgment on. It is clear, however, that he chased them to the alley, and when she stumbled from the first shot, and lay pleading for mercy, he shot her again "to send a message." There is no question that this does not qualify as self defense. It was cold-blooded murder, but he will get by with it because he is white, from an upscale neighborhood, and they are (your words) "trash," "animals" and black (Adams). The law will once again be enforced selectively.

I don't care what color he is and I don't care what neighborhood he lives in. I guess it only matters to you.........
I never related anything about race, but it seems to be real important to you. Are you saying that because their race is different 9white I believe you claim) and his assailants were white, it is a race crime.........now that's really a stretch..........
and as far as animals go, what do you call anyone who would beat up and 80 year old man for money? A politician?

Only because of the racial bias of law officials. Black people are far more likely to be arrested than white people. I thought I made that clear.

You're not comprehending. The murderer is white. The unarmed man and his mother who were arrested and charged with murder are black.

Who said they did that? OH right... the murderer.

your implication is that he walked out of his house and murdered someone just for the thrill of it?
That these people never burglared him?
Gawd, what a hoot.............and now you are playing the race card and blaming the shooter?
so, you are charging him with a race crime?
So, for the record, he shot a girl for no good reason, that she never broke into his home with her boyfriend, beat the hell out of him, and stole from him? Because he's a racist?
    omg..................

    Where did I imply that?

Look, you said the murderer would never be convicted if charged, and I agreed with you, because there is racial bias on the part of law officials. I never blamed the shooter for racial bias, how ever did you get that idea? Are you being intentionally obtuse?

Correct, he had no good reason to MURDER her. It was clearly not self defense.

No one "beat the hell out of him." In the next day interview, he didn't appear injured at all except that he was wearing a sling which HE explained as "that was where I fell." Yes, they allegedly broke into his house and attempted to burglarize it, and that's based entirely on the murderer's story.

Exactly, you are defending a man who killed a woman who had stumbled and lay pleading for mercy when he clearly was in no danger. OMG...
