    It's suggested the fetus is a person with rights, and so you can't kill it.
    And so when the fetus must be regarded as a person, than it can't be in jail for a crime it did not commit.

    she did not have an abortion, she is using the anti-choice logic to get out of jail, if it's a person, then she has a point... is it?

    It’s not a person, it goes to a nursery after being born while the mother remains in jail for murder.

    I can appreciate the attempt at exploring a legal loophole, but I think a court would likely shoot this down in a heart beat.

    Even if we consider a fetus it’s own distinct legal person (I don’t think it is), you’d be hard pressed to demonstrate that its material conditions are any different for being in a womb that’s imprisoned.

    It's either a person who you can not kill by way of an abortion, or it's not a person.
    I doubt the court is going to make it an identity flued lifeform.

    The court wouldn’t have to see a fetus as “identity fluid” to shoot down the case mentioned in the OP.

    In what way is a fetus’ material conditions different in an imprisoned womb vs one that is not?

    Excuse me but if a fetus is not a person then how can abortion be murder? (Not that the woman in this particular case had one.) I see a legal dilemma in those States with very strict bans on abortion developing. I wonder how they'll word the legal work-a-round. Should be interesting to watch.

    So, anti-abortionists. If it has been shown that the miscarriage rate among imprisoned females is higher than those outside
    the Prison environment, then if you consider the fetus a separate person, how would you justify keeping a
    pregnant person in prison - the right to life, and all?
