The conclusion of which is ignored by the major news media. What is also ignored is what the NY Judge said about the 2nd Amendment. Which you can only find on sites that are not main stream. Now, everything that I have read on this guy is that he's a hobbyist. He wasn't selling the guns, and none of the guns had ever been shot. He was simply fascinated in making them. Though he did think about opening up a business in gunsmithing. He's also a man with a clean record of over 50 years. Thankfully it appears that he's going to appeal this all the way up to SCOTUS. And considering what the judge said I have no doubt that it will make it all the way up to SCOTUS if, for some stupid reason, the appeals court doesn't backhand this judge. She obviously did not allow this guy a full and proper defense.
This isn't a 2nd amendment case. It is about assembling (manufacturing) items that require certification. It's a safety issue. I've known private gun makers and they always register their production.
A private gun maker does not have to register the guns that they make for private use unless it is a specific type that falls under the NFA (think automatic weapons type category). They can if they wish to, and many do just to avoid headaches, but it is not required by any federal law. There may be State laws which require such, but States are still subject to 2nd Amendment challenges to such laws. This judge would not allow such a challenge.
And I'm sorry, I was going to ignore this part of the argument but I simply can't let it go.... Safety? WTH does "safety" have to do with registering a gun? Absolutely nothing. Registering a gun does not somehow make that gun safer. It doesn't prevent anyone from using it in a crime. It doesn't prevent an idiot from having it where a child can get a hold of it. It doesn't prevent it from being stolen and then used in a crime. It does nothing in regards to safety. At all. Its a piss poor argument.

Things to Consider Individuals who make their own firearms may use a 3D printing process or any other process, as long as the firearm is “detectable” as defined in the Gun Control Act. You do not have to add a serial number or register the PMF if you are not engaged in the business of making firearms for livelihood or profit.
it will go to the SC, sure it will get reversed as the 2nd would cover it as long as owning a gun is a right, it's no different from choosing a religion..... we can require cars be licensed as there is no right to own a car.. it's a privilege then again, voting is a right....
Clarification....driving a car on public roads is a privilege. You can own a car without registering it so long as you do not drive it on public roads. You can drive it around on your property as much as you want without registering it or even having a license.
I mentioned this is in E Jean Carroll gun thread because he was charged and she was not. A lot of people on this forum were oddly saying it isn't a crime to possess a firearm in NY without a permit in an effort to defend Carroll. Selective prosecution is also an argument now. It's a difficult burden to cross, but with the mandatory minimums per charge, it's worth trying. In order for the law to be just it must be applied evenly to all regardless of whether or not they're making public accusations against a political candidate NY politicians dislike.
Things like this is why I've told my kids that if they ever live in NY (or California) then they'll have to come visit me because I'll never visit them as long as they live there.
