Granting foetal personhood

    Okay let us say that the whole legal profession let greed overwhelm common sense and push through legislation saying the foetus is a "person"

    Would then the foetus have rights? Which rights would it have? (Odd mental image of 2nd amendment applying)

    Would it have the "right" to a "toxin free" environment (mum you had better give up those smokes!)

    Would it have the "right" to optimal nutrition (forget that diet you were going to go on)

    Does it have the "right" to a stable environment (no rides on bumpy roads please - and er..............well.........)

    Does it have a "right" to own property?

    It would not be the "legal profession", it would be Congress and I can't see how it has anything to do with "greed".

    Legislation can't grant constitutional rights, that would require a referendum. Would likely just be the 5th and 14th that are amended to overturn Roe vs Wade by extending "persons" to include the "unborn". Probably there would be a specific part about prohibiting or limiting abortion. So it would only be the right to life.

    Obviously there are a lot of rights that have no relevance for a fetus.

    Most of what you listed aren't rights btw.

    I was thinking in terms of lawyers salivating at the thought gf a client that could not talk back but who would have plenty of opportunity to sue - after all they are already starting with the "wrongful life" lawsuits.

    But I meant this to be pure speculation. A real "what it" if you like to get people to think about the ramifications of granting "personhood"

    The comparison would be to how children are protected in society. They also have no voice.

    Well abortion would be a criminal matter prosecuted by the state.

    Wrongful life is instigated by the parents. I'm sure this is a very emotive issue for people, would not like to be in this situation myself.

    Rights do no necessarily have to come as a "package deal". I think that you can grant the right to life for an unborn, and not grant any other rights.

    I think the laws are fine the way they are.

    Giving a fetus the right to life is far too messy imo. Brings up all sort of issues for the mother. Being pregnant could become a legal minefield.

    I think everyone's time would be better spent promoting safe sex practices and sexual education.

    I can't argue with you on that last one - these threads are about getting people to THINK

    It is bad enough when we have to report a woman to Dept of Child Safety because she is pregnant and a substance abuser but it could so easily become vindictive

    The fetus already has these rights, from an observation of the pregnancy of my classmate. More in detail, inlined.


    Yes, 2nd amendment. Kicks the mom into the stomack (from the inside), and makes her loose her breakfast. (As good as a bullet, especially if interfers with water retention.)

    Yes, craving for the strangest, yet untested food in the family, through the mom's tantrums.

    See previous line. What rights? Takes it when it wants it, where it wants it, doodoos into the rights.

    Yes, mom, better dare not get up from the sofa for a few months.

    Owns your female ass, starts with slapping you out of shape, you slave. (It master.)

    Would you like to appeal to something higher?

    It doesn't have to be "granted" it has already been recognized by many state legislatures and the federal govt in the unborn victims of violence act.

    Define substance abuse. No, I mean it - define it. Here you will be reported if you turn up to a hospital drunk and pregnant

    When you are pregnant, getting drunk is an assault on your child in utero. I am OK with reporting that.

    Even if the woman did not know she was pregnant at the time?

    Okay - now let us get a little more questionable - how about someone who is taking prescription pills - going to report them too??
