If you want to get technical, there is probable cause to suspect that a crime was committed. That is what investigations by competent authority are for. In US v Nixon, the Supreme Court defined a specific exception to EP relating to a criminal investigation. While the circumstances are not exactly the same here, the subpoenas being defied have been issued by the correct, co-equal branch of government. Once again, EP was not intended as a tool to conceal crimes.
