The two "recent memos" by the OLC, as far as I know, were written during the Watergate era, by a Nixon DoJ and during the Clinton impeachment period, by a Clinton DoJ. Both of those memos upheld the theory that a sitting president can't be indicted. However, there was a third opinion, written by a constitutional law professor from the University of Illinois, at the request of Independent Counsel Kenneth Starr, which concluded the opposite. Starr was replaced before the conclusion of the investigation by Robert Ray, who found there was insufficient evidence for prosecution, thus the Illinois professor's opinon was never used. In Nixon's case, DC federal judge John Sirica did order Nixon to turn over the "tapes," noting that no one is above the law, while presiding over the trial of the Watergate burglars, and the Supreme Court upheld Sirica's decision. Nixon did hand over the tapes, but resigned before being prosecuted and/or impeached himself. I think that may be as close as the Supreme Court has come to ruling on the "non-indictment" theory.

I doubt DoJ policy decisions, based on OLC memos constitutes a "legal precedence," since they are more procedural than legal decisions. It's possible, in this case, the OLC opinion would have reversed the two prior OLC memos, or not found the Trump obstruction of justice charges comparable to the Nixon and Clinton circumstances. I don't know and it seems we'll need to wait for the memo's release or an appeal to prevent its release.

 

Lawyers seem to usually take all the time the Judge allows them...she gave them two weeks. Her decision was just released yesterday, so Garland may not take the full two weeks, but I wouldn't be surprised either way.

She's not bringing ANY charge. Her decision to order the release of the un-redacted OLC memo is in conjunction with her presiding over a Freedom of Information case brought before her Court. As the presiding judge in that case, she was given an un-redacted copy of the memo. Apparently, as a result of that reading, she's concluded that she was either misled or lied to in a prior case...ergo her order to release the un-redacted version, which is essentially a ruling for the plaintiff in the Freedom of Information Act case.

Only a lunatic would suggest wrongdoing on the part of Hunter Biden without evidence, which is something that World-Third Donnie and his supporters are not concerned about. If a strong criminal case existed against Hunter Biden, a political hack like Bill Barr wouldn't have hesitated to bring charges.

On the contrary...she's the presiding judge over a law suit, under the Freedom of Information Act, in which the plaintiff is asking that the OLC memo be released un-redacted. Not an expert, but my guess is that in such cases the issue is does the government's right to secrecy outweigh the public interest in knowing what the un-redacted memo says? To make that determination, the judge (or a jury if one is involved) must have access to the un-redacted material. She read it and determined the plaintiff was right and ordered the release of the un-redacted memo.
