    Texas is taking Biden off the ballot. I think that is the prudent thing to do if he, like Trump, is ineligible.

    States can't enforce it...lol. It's enforced by the Federal government when a candidate registers to run for president.

    I disagree.... Unless Biden has been found guilty of a crime, there is no reason Biden should be removed from any ballot.

    Well, Republicans are saying he is guilty as sin, and to be honest, - the Constitution does not call for conviction either. The Constitution is clear, - if Biden engaged in an insurrection then he is disqualified. There is no ifs or buts about it.

    Section 3 stipulates that a candidate is disqualified if he or she has participated in an insurrection or given comfort to insurrectionists.

    No mention of convictions.

    No mention of "self executing", which means the 5th and 6th Amendments still apply

    After the unconstitutional actions by the Colorado Supreme Court and the Secretary of State in Maine, any Democrat who claims that their party is not using the courts and the legal system as a political weapon has egg on their face.

    I don't like Trump and don't want him to get the Republican nomination, but I am even more opposed to disqualifying candidates from office using the courts or one rogue state politician. It sets and dangerous precedent. The ballot box is the place to elect presidents, not the courts or the Maine Secretary of State's office.

    Not without due process. It's not merely arbitrary. Every citizen is entitled to a trial to adjudicate their accusers.

    That's your opinion.... which is not shared by the majority of Colorado Superior Court judges.

    However, section 1 which is above section 3, clearly states that every citizen is entitled to due process.

    Yet, the vast majority of supreme court justices that have viewed this in other superior courts disagree emphatically with the 4 justices of the Colorado Supreme court. Even 3 dissenters where pretty harsh on the 4 other justices rulings.

    I agree . Trump’s trials should start immediately . That way his guilt or innocence can be determined before the election.

    Why is Trump trying to delay his trials ?
    Why doesn’t he want to run as an innocent candidate ?

    He needs to be charged before he can go to trail. However, they will never charge him with it, because they will lose demonstrably! The other trials, those could have been charged and scheduled vastly early, however you all are trying to have these all during an election period... Why do you think that is?

    That isn't an election law.
    States have 100% power to administer their own elections. There are no laws telling a state how to administer it's own elections.

    Quite true. BUT Trump also has not been convicted or even charged with insurrection. So these actions have no legal basis.
