Mediation the ME way

    Recently there has been in news of an issue in Egypt between a wealthy businessman and a resident of one of the new cities.

    Apparently the businessman (Khamees) slapped (Fahmy) across the face as he demonstrated outside his office.

    I am putting this here to show a bit about how a lot of issues are dealt with in this region.
    By mediation as opposed to dragging something through courts.
    This is what Sharia is based on. Mediation.

    The man Fahmy could have taken his case to the criminal court but he declined and accepted mediation.

    In this case the two met in a neutral environment where each was allowed his say with mediators present. Often this would be a sheikh involved in Sharia.

    In Sharia it is not looked on favourably if someone takes personal compensation, but that must be offered by the guilty party.
    Most Muslims refuse personal compensation in these cases. Thats a religious thing where it is better to forgive than to get a material thing in exchange for forgiveness.

    This case resulted in the businessman offering community compensation which is quite normal here.

    The businessman apologsied for slapping the man Fahmy and Fahmy asked that any compensation offered should go to the community.

    The businessman agreed that he would pay for 10 visas for 10 poor Egyptians to do Hajj Ummrah. He would assist in helping residents in Ramadan City the place Mr Fahmy lives. He would buy 5 ambulances for the city. He would pay for the treatment of a patient suffering from kidney failure.

    Mr Fahmy insisted he wanted nothing more than apology and at the end of the mediation they shook hands and it was resolved.

    In this region a lot of issues are resolved in this way. This is what Sharia is about. This is what Islam is about. Muslims often prefer resolution of issues by mediation and not courts. Issues are solved quickly. It also creates a system of people becoming experts in mediation and often in this region you will see members of the public step in in disputes to resolve them rather than calling police.

    Abu its called an out of court settlement and it happens all the time in the West. Michael Jackson made out of court settlements with parents of children who accused him of abuse. There are obvious drawbacks for justice as so much revolves around the individual circumstances of the perpetrator and the victim. Was the businessman essentially blackmailed with the threat of damage to his business as the size of the settlement suggests? Is it fair that rich people can pay their way out of their crimes and a victim's compensation depend on the wealth of the perpetrator and the going rate for crimes against someone of such and such a worth? How does mediation work in a case like Lara Logan's? Is it up to her to investigate and find the individuals responsible?

    Tyrerik, surely who know , life is not FAIR . rich people the world over , has more often as not , been able to pay up + avoid physical punishment /imprisonment.

    Re Lara Logan , do you know whether the Police have carried out investigations + tried to trace the criminals ?

    I wasn't suggesting life is fair however that is no argument against working to make it as fair as possible is it?

    No I don't know if the police have carried out any investigations however judging by what Abu Sina has to say as an Egyptian it is up to Lara Logan to investigate, try and trace the criminals and bring a case. I think had anyone been arrested we would have been able to read about it in the media.

    " If you want justice , go to a cathouse and go to court ,if you want to get F****d . "

    I'll always do my utmost to keep away from lawyers and courts.

    Sorry, I cant see where Lara Logan is mentioned in Abu Sina's post. Let's try not confusing a rape with a slap.

    No you missed the point.
    In Islam it is better not to take compensation.

    In Lara Logans case she should sure CBS for sending her back after she was deported the week before, and for sending her into a revolution where the Pro Mubaraks were targeting foreigners, especially blue eyes blond female American ones.

    You don't kid anyone. His compensation is in the debt of gratitude owed by the members of his community to him and an asset able to be cashed in at a convenient date and occassion. This is standard custom in honour cultures where things are not transparent.

    I am sure Lara Logan had clauses covering such eventualities in her contract however that has nothing to do with your Islamic system which is what you are peddling here. Now are foreigners or non Muslims excluded from the system or are serious crimes not covered? If not Lara logan then can we have some examples from the very common molestations of Egyptian women? If a slap is worth so much what about a pat on the bum? Is that perhaps only worth a slap on the face?

    As for trying to pass on the blame to pro Mubarak supporters I've already dealt with that and there is nothing to suggest that the anti Mubarak camp is any less hostile to foreigners than their opponents. If anything more foreigners have been harassed by revolutionaries than the previous lot as your posts have shown. I'm curious, which other blond blue eyed American women have been targeted we haven't heard about and why especially them? It couldn't just be a case of sex appeal and looting could it as I've described it?

    If you are a Christian American and have a problem say a bump with your car and someone rund into you then here we settle it in the street mainly. People will turn up and mediate. Whoever was to blame will pay for the damage, or if no damage they shake hands and go on their way. No police involved, Religion or foreigner makes no difference. It's quite simple to understand really.

    Anti American feeling is growing day by day around the world, it is not exclusive to Egypt.
    In the case of Lara Logan it was Pro Mubaraks. She was not in Tahrir Square as she said but in Shera'a Tallat Harb. All exits to Tahrir were blocked off and Shera'a Talatt Harb was a meeting place for the pro Mubaraks. No one could get into Tahrir without being searched and reporters and foreigners were not allowed to enter. The only reporters in Tahrir were Mohyeldin from AJ and a few Press TV ones who are Egyptian. They got in as protesters.
    Logan was chased down Tallat Harb towards the barriers into Tahrir Square where she was met by Anti Mubarak female protesters and they let her enter and 'inside Tahrir was the army. They took her to the army tanks insdie Tahrir.

    She lied about being gang raped and she lied about being in Tahrir instead of Tallat Harb St.
    That's why you hear nothing from her.
    She was not gang raped by 200 men.
    She was at most molested by the pro Mubaraks and she was lucky not to be stabbed to death by them as others were.

    Well my wife has quite a few Western friends and is in a group with Egyptians an ex pats and she hasn't mentioned anything about any of them. They go about their business, go to work and live as normal except only one woman who had to return to the USA to find work to pay back thousands of dollars in credit cards when she lost her job after the revolution and couldnt get a visa renewed.
    She is still looking for a job in USA last time I heard and that was about 5 months ago.

    I am sorry if you have difficulty understanding what I write however it is not my English which is at fault, others have no problem.

    My friend had a bump in our local Muslim ghetto. The car behind him didn’t stop in time and ran up the back of his. Amazingly by the time he got out and went to the rear of his car a crowd had gathered and some were busy removing the license plates from the offender’s car. There was very little he could do except to drive off. Fortunately a neighbor had witnessed the accident and knew the driver of the car so the police could take action. That’s my rather different experience of your mediation method. Judging by your street culture with the Lara Logan case in mind I think my experience probably gives a more realistic picture than yours.

    Do you have evidence of this global growth in anti-Americanism? I think its rather difficult to judge but my impression at least is that there was a reversal of the trend since 9/11 after Obama took over. Why would the mood in Egypt be increasingly anti-American, is it because your new junta needs a scapegoat?

    I haven’t read anything from reliable sources to indicate that Lara Logan has not told the truth in her account of what happened. Can you link to any? It seems like just more of your chauvinistic character assassination response. I’m sorry but I find her considerably more credible than you.

    Well then where did you get the idea from that blond blue eyed American women were being targeted? Lara Logan wasn’t even American although I suppose certainly close enough for your mob.
