It's illegal to come into the US without going through a port of entry. Once you are in the US, you can claim asylum. You cannot claim asylum if you are convicted of a crime. So, I'm not sure why we can't charge the people with the crime of coming in to the US illegally, and once convicted, it would nullify their claim for asylum. We just have to make sure that the trial for entry is before the trial for asylum.

 

I answered your questions directly. Trying to avoid answering is nothing more than an attempt to keep the pain and suffering incentivizing illegal immigration causes, out of frame.
