This is just a temporary block, but I'm glad to see that this is getting recognized in the judicial realm! Perhaps this could be a case to go to the SCOTUS. "nor shall any person ... be deprived of life, liberty, or property, without due process of law" Seems clear enough to me.
Once again, the courts are the protectors of the Constitution, while the legislature panders to idiots.
What scares me is how few news sources are covering this! CNN? Nope.New York Times? Nope. NPR? Nope. Al Jazerra even? Nope. I only found out 'cuz I saw a comment piece in the Guardian (UK) written by Naomi Wolf who was attending as a witness for the plaintiffs. Maybe they will have something tomorrow, but I check the websites of those 4 and nothing yet...
There is an awful lot of judicial activism coming out of New York these days. I just wish she was in charge last April when her predecessor decided that we Americans couldn't be responsible enough to play poker from the comfort of our couch.
Great news for sure. Always felt that particular provision was just as bad as the stuff in the patriot act. as for the courts and the like, my only real issue, is that the Supreme Court doesn't fall under the same ethics rules as all other judges. Should be the same all around.
