Refusing to cooperate with returning the documents by Trump is the most obvious difference. The old man defense is the other side of the double edged sword for you guys always saying Biden's too senile to be competent.

 

Trump defied many attempts to retrieve the documents. Biden's people proactively brought up his classified documents needing to be returned and did so. It's just not on the same level.

 

The prosecutor is saying basically Biden is too senile to charge. Well, it is his job to PROVE that he is to senile to charge, not simply say so and close the case.
Never mind claiming his inability to know right from wrong then, but his inability to assist in his defense now.
Uhh... Excuse me, but Biden's presidency has been gutted like a fish by the DoJ.

Trump nation conveniently re forgets that Biden invited the FBI in, while Trump lied to the National Archieves, not once, but repeatedly, defied polite requests, defied a subpoena, had to have a warrant served on his. Continued to withhold documents, necessitating a return visit, and instructed his lawyers to lie about it.

Sad, but not at all surprising.

I agree with you Mr Kelsoe. This bloke Hur is a Humpty appointee. If there was evidence of the commission of an offence by Biden it was his duty to prosecute if that evidence was enough to establish a prima facie case. It is not his job to pre-empt what a Jury might do or consider in the absence of hard evidence, not his own speculation. Further, if Biden wants to argue infirmity/lack of wilfulness as a defence then that is on him, and it is not for any Prosecutor to just fly a white flag.

If it was up to me, I would not pay Hur a cent as he has failed miserably to do the job he was asked to do. Bugger this stuff, if it's good enough to go after Humpty, it is good enough to go after Biden, even though I acknowledge the cases are at different ends of a very wide spectrum.

My gut feel is that this bloke, a Lawyer, not a psychologist or psychiatrist qualified to gauge the mental capacity of anyone with any expertise at all, has taken a cheap political swing and all he has done is amateur and pretty obvious mud-slinging.

Do your job!! Charge and prosecute Biden if there is sufficient evidence as I have described, and if he (Biden) has an effective defence of any kind that is on him to raise via expert evidence!

If there is insufficient evidence to secure a conviction, that is what he should say very clearly. Venturing into amateur unqualified armchair diagnostics on the mental capacity of an individual is not his professional job or within his expertise. That is the job of appropriate and relevant experts.
