    He'll end it along with the rest of the Constitution, and he'll call it "freedom" and say its "for the children".

    Why weren't your grandparents deported before they had you?

    Is it because they were under the jusrisdiction of the United States?

    First birthright legislation just dropped...

    Gaetz introduces legislation to end ‘unqualified’ birthright citizenship

    Rep. Matt Gaetz (R-Fla.) introduced a bill Tuesday that would end “unqualified” birthright citizenship for children whose parents are not themselves U.S. citizens.

    The legislation, titled the “End Birthright Citizenship Fraud Act of 2023,” would amend the Immigration and Nationality Act “to reflect the original intent of the 14th Amendment’s ‘subject to the jurisdiction thereof’ clause,” according to a statement on the measure.

    No chance it passes the Senate, let alone the President signing it, but it's a start.

    It wont pass the House either because it would send too many Congress Reps, like Rubio or Ted Cruz packing. Also, isn't re-defining the 'original intent' a job for the Supreme Court, not junior Congrss critter?

    No matter what, this issue would find itself in front of the Supreme Court, because this bill is entirely based on the original meaning of ‘subject to the jurisdiction thereof.’ But a law is the right way to handle this. Trump and DeSantis have proposed an executive order, which I just don't think would fly constitutionally. That would end up in front of the SC too, with a likely action of the executive order being found unconstitutional. This way the court is only looking on what the original intent of that clause is, so it's far more likely to get a positive outcome.

    They would have to remove ‘subject to the jurisdiction thereof' in order to eliminate the right. Anyone who is in US, including tourists, are are subject to U.S. laws, so that's a no-brainer.

    And they will cease being subject to American jurisdiction after they are deported.

    At that point, they no longer derive American citizenship under or through the 14th Amendment.

    Also bear in mind that the 14th Amendment is not the only source from which people have citizenship. It does not define all citizenship.

    Keep in mind it says they "are citizens", not that they are "granted citizenship".
