    If the SCOTUS thought Trump doesn't have an immunity case, when would they rule in favor of Trump?

    1st off, the SCOTUS can't make that ruling. Its not their case. Its in the appellant court.
    Thats why they ruled the way they did.

    It does seem a tad suspect that they could / would not rule on that. Suspect that politics factored in.
    Why on earth would a President be immune from the law?? That would be a dangerous loophole. ( and create a fettle atmosphere for people like Trump to abuse the role as he wished He has shown how little he respects boundaries of any kind.)

    I understand you tried to claim Smith was trying to speed up the appeal, not prevent it, when he was actually trying to use the SCOTUS to have his trial before the appellant court ruled. Which is why he got shot down.
    And the same reason you were wrong
    Thats what I understand. lol

    Do you think the appellate court ruling will mean anything???
    If they rule for trump( unlikely), govt will appeal.
    If they rule for the govt, trump will appeal.
    This is going to Scotus. Only question was when.

    Nothing he’s charged with were part of his official duties. I can’t fathom how this goes in his favor. Just a stall tactic I think.

    That’s exactly what Trump wants, to delay the trial until after the election. Polls have showed if Trump is convicted of a crime, his poll numbers plummets. It seems to me that Trump doesn’t want the American people to know whether they’re voting for an innocent man or a guilty man. Be that as it may, there’s another case, the Colorado case which their supreme court has ruled Trump an insurrectionist but stayed their ruling pending appeal that may have even bigger repercussions in the end. Even if Trump were to win the election, he still could be barred from the office of the presidency depending on how the appeals turnout. Time will tell. Then there’s still the Georgia case for election interference scheduled to begin 5 Aug 2024.

    I have no doubt that Trump prefers to wait on his appeal for presidential immunity because if he wins that one (And I'm not saying he will or won't) Jack smiths case is over.

    But I wouldn't put much stock in the 4 justices from Colorado's claim since the SCOTUS already kicked that idea to the curb last October.
    Once you allow judges to claim people have committed crimes instead of the 6th amendment, this country goes into chaos in a single ruling.

    Delaying his trials after the election is Trump’s sole “stay out of jail card”, and every above average intelligent people know that.

    If Trump wins his immunity claim, then I’m wondering what Biden/future presidents could do before and after an election, and be immune from all prosecution?

    Thus, a win for Trump would certainly open up a pandora box.

    I don't think its immunity from criminal charges. I think its immunity from civil claims.

    Actually, SCOTUS has the mandate to hear ANY case at any time they choose if it involves Constitutional questions. It's called the power of Original Jurisdiction.
    It is not a "win" for SCOTUS to refer the case back to the Appellate Court first. Just means they want more time to prepare for what they know is coming.
