Should a rapist be punished more if he takes her virginity?

    I think the trauma has to do with the circumstances and the power held over the victim end of story.
    Virginity or not has NOTHING to do with anything. Dear lord do you not think women can use the internet? And “virgin” how? I mean I am no longer 24 but I assure you my left ear is still a virgin - the rest of the body isn’t but that bit is

    What you are, very badly and clumsily, attempting here is the old “Well she must have deserved it” excuse

    Every rape is bad, some are worse though than others due to the actions of the rapist rather than the previous sexual experience of the victim.

    There is a field of study looking into crimes and victims and victimisation It is called Forensic Psychology

    You post has no iota of any validated information from that field

    When it comes to an argument like that you can.

    True enough, but it still illustrates the error of an argument like "was once the majority culture of the entire country." That argument by itself is never enough, because there will always be both good and bad (for all that those are subjective values) as part of a culture's past. For the record, I would have called you out on that argument even if I agreed with your overall position.

    There is an old joke about an old lady who goes to a funeral home to buy a coffin for herself “just in case”. She is looking around and spots one with a deep purple satin lining. “Oh! My! What a lovely colour I think I will have that one!” The funeral director clears his throat and says “Sorry madam but that is one we would use for “ladies of the night” who have been “sinful”.

    The old lady looked thoughtful and said “In that case I will have one with just a touch of lavender”

    Or try to turn back the clock to when prostitutes could never be victims of rape and murder because they “deserved it” and “brought it on themselves”

    True but it's not just prostitutes....some believe that of any raped women....

    With so many threads on the theme "rape isn't so bad" it's obvious some want to just decriminalize rape so men have it easier.....and women can't complain..

    Do you even know what 'sexual maturity' refers to?

    Any mature man (or woman) should not care about previous sexual experience. What does it matter?

    Whether the new spouse has had previous partners or not shouldn't matter. There are many first sexual experiences. Every new partner means you are having sex for the first time with them and are hopefully establishing a more deep connection and stronger foundation of a relationship with them.

    Why are conflating 'first sexual experience' with rape. Rape has nothing to do with sex. It's a violent act. It's nothing to do with 'sexual experience'.

    I am curious on your definition of virginity and why it matters so much.

    What does it mean to be a virgin?

    Do you know that some feel that virginity can't be taken through rape.

    How can 'a rape be more of a rape' just because somebody is a virgin. That is totally and egregiously insulting to non-virgin women who have been raped

    Just because somebody is a 'virgin' doesn't mean they don't engage in other sexual activities. There is a reason why during rape trials, the defence is not allowed to bring up the past sexual activity of the woman who was raped. So let's say that people who rape virgins get a harsher sentence, how would it work. First thing, there would have to be a discussion of whether the woman was actually a virgin or not. And how do you actually prove somebody is a virgin to start with? Some kind of discussion ensues where the rape victim manages to convince the court that she is indeed a 'virgin'. During the discovery of whether she was a virgin or not, it came out that the woman in question, even though a 'virgin' had engaged in everything but intercourse with numerous partners. It doesn't matter but nobody should have to go through this kind of questioning and exposure of their private life in a court room, in front of their family, and the community. This kind of differential of sentence of virgin vs non-virgin opens up the kind of unfair questions that women fought for years to get banned during rape trials.

    Why should it be taken as a factor in the punishment? How is it more fair to a non-virgin? Her rapist is going to get a less harsh sentence just because she wasn't a virgin? Can't you see how problematic that is.

    Are you familiar with who Jerry Springer is? He hosted "The Jerry Springer Show" which was the epitome of trash tv. It was so awful (the topics and guests, viewers loved it) that he had security in the front row.

    I requested tickets to be in the audience. You could only select the dates so there is no way to know what the topic will be.

    Add all the above together.

    The show we attended was so disgusting (along the lines of your meme) that Springer's attorneys would NOT allow it to air. No joke.

    It could refer to a couple of different things.

    If you're merely talking about physical body development, that can start in girls as young as 12.

    I think it can be assumed we are not merely talking about physical body characteristics?

    No, I cannot.

    Is your argument that this is a slippery slope if we start treating some women differently from others?

    Look, one woman has been more violated and more damaged than another. Certainly any punishment should reflect that.

    I disagree with that. I am aware of a case where a man was wrongfully convicted of rape because they were not allowed to bring up the woman's history.

    (The woman had a history of filing false accusations of rape and even accused her own brother on one occasion when she was mad at him, but the judge refused to let that fact be presented at trial. She also had extreme mental and psychological problems and harbored a hatred against men. And she was a drug addict, but the judge refused to allow all that information at trial)

    Because the woman is no longer a virgin. When the woman finally has sex with her husband or someone special, he will not be the first one she had that intimate soul-bonding experience with. This is very important to some women... and men.

    (Maybe the problem is you are having trouble understanding this because you cannot relate)

    You have to concede that it is especially awful if the woman's first sexual experience was a rape. It will probably mess her up even more than if she has an already established sexual history.

    Yes, people do get convicted when innocent, unfortunately. However, just because a woman has a history of false accusations, is a little bit nuts, was a drug addict, and hated men does not mean that she wasn’t raped. What if she was raped and the introduction of this kind of ‘evidence’ resulted in the man not being convicted. A person can hate men, do drugs, be mentally ill, and even have made prior false accusations — it doesn’t mean they haven’t been raped.

    I don’t think his trial was fair but who knows. Anyways, the rape-shield law may not be fair to every single person but it’s best for the majority.

    I am sorry but I think you are the one who can’t relate and it’s obvious you can’t fathom anybody’s point of view but your own. Rape is a violent act and messes everybody up in so many ways. You are just assuming a virgin will be messed up more. How do you know this?

    And again, why on earth should a non-virgin be traumatized even more by the fact that because she has had sex, her rapist will get a lesser sentence than somebody who is a virgin. Should their be differences between single and married women as well? Should the court consider whether or not the rapist knew the victim was a virgin or not? How about men who rape women who are in coma’s (it does happen), should they get an increased sentence if the comatose woman was a virgin?

    Virginity was used in the past by men to control woman and to treat them like absolute villains if they dared to have sex when not married. There are still woman on this planet who are murdered by their own brothers or fathers for not remaining a virgin for their arranged marriages. Are you one of these people who believe virginity is some sacred state?

    You still haven’t answered my questions about ‘virginity’. Again, do you believe that virginity is some sacred state that should be honoured in a court of law over those who are not virgins?

    These are really complicated issues and cannot be seen in black and white terms. I believe that nearly 100% of the guys out there would want their wives to be virgins [but have little problem diminishing the available pool of candidates along the way]. If there was societal support for such, the number of virginal men and women [remaining such until marriage] would be a great deal higher.

    The sixties accomplished many things [good and bad] but among the worst of it, introducing drugs and sex as recreational activities was not such a wonderful idea. We are living the result of such narcissistic indulgence as we speak.

    Why would it matter if your wife was a virgin or not? Does it matter if the husband isn’t a virgin? Basically, men were allowed to have sex whenever and with whoever and they were applauded. It has only been women who were vilified for not being virgins. This is misogynistic. Times have changed. Praise be.

    No it's not. This is one of the millions of reasons there are differences between men and women. Why do women do all the wacky stuff they do on a regular basis?

    It's just the way it is. Just the same, everybody has a choice.
