Judge Merchan drew the line in the sand, next stop, jail.

    But should he?

I say, damn the political torpedoes, lock him up. But, of course, you knew I'd say that.

If he doesn't, he's giving Trump preferential treatment (hell, he's already doing that, no criminal defendant other than Trump would be allowed 10 violations) and the next criminal defendant could holler 'they didn't jail Trump, why me?', and they would have a point. I think he has to, my personal animus aside.

If he does, the right will yammer on endlessly, pundit's heads will explode, death threats to Merchan, et al, on and on blah blah blah.

Frankly, I don't give a damn. This man has never had to account for his bad behavior since he was in military school, and it appears they didn't teach him any lessons when he did. He's a brat toddler who needs to be told to go to his room. Make that room behind bars, he's old enough. It's not about free speech, it's about the integrity of the trial process, when Trump is bent on damaging it.

    What say you?

No. I’m thinking the judge will continue to give Trump preferential treatment. Anyone else would have already spent time in a cell.

As long as it's a clear violation, yes. What's difficult is that it's not too hard to feel intimidated when Trump speaks. His followers were screaming about hanging his VP, after all and it's not like Trump had to be that specific, just disparaging to Pence. So his words really have more effect than the typical defendant.

Yes, he should definitely put Trump in jail for saying that Manhattan is a solid blue area and that the jury is 95% Democrat.

That is seriously one of the violations cited. The fraudulent judge has lost all credibility.

Anyone else wouldn't be (shouldn't be?) on trial under false charges.

The legal definition of a "threat" requires very specific language, that only be taken one way.

Trump saying that the jury is, "95% Democrat", and, "mostly Democrat", isn't a threat and can, in no way be interpreted as a threat.

I think intimidation is the word, which is a lower standard. I mean, there's a reason mob bosses could get away with murder for so long. Because it takes little more than a nod for them to order a murder. Trump implying the jury is rigged and an extension of the democratic party really does put them in the crosshairs of his followers. It's sort of like he suggested Pence is a coward, but the consequence is his followers wanted to hang Pence. Trump ought to know his words carry more weight than a typical defendant.

Gag orders protect criminal defendants going through the process, not the government.

A person can take over a campus, vandalize, spray paint crap on the walls, take over buildings, shout death to America, and I highly doubt that person would spend time in jail or even be fined. But if a defendant speaks to the validity of the case against him....

Trump blamed Pence for Jan 6 riot

“Had he sent the votes back to the legislatures, they wouldn't have had a problem with Jan. 6, so in many ways you can blame him for Jan. 6,” the former president said, March 13, 2023

    ————-

That is sooooooooo dishonest, uncivil, and unacceptable. He’s a scumbag!

Are you saying that a regular person would be prosecuted on false charges?

I've never seen Trump supporters dox Supreme Court justices, protest in front of the court or their homes, Tweet that someone needs to 'take one for the team' (Kavanaugh), offer rewards to public sightings of the justices so they can be intimidated at restaurants or attempt to kidnap and kill a justice.

Trump could also give the name/address away of a witness or juror which would be fact, but still violates gag order.

i didn't say that's what he did (hence the word 'could'). I'm correcting you in that just because somebody states a fact doesn't excuse them from a gag order.

Since he didn't do that, there's no need to even bring it up.
