Stateless Legal Order - 1

    May I ask if this stateless society has abolished establishment of a state? It would stand to reason that in the absence of a state, any market would create one.

    This is THE question.

    It would have to be a society of people who have become conscious of, and rejected the idea of statism as a system of governance in the same sense in which most people rejected monarchy as a system of governance a while back.

    It would have to be enforced, then by whom? Someone will break for leadership and others will follow. Together this group will be dominant to the more anarchical group. With monarchy, constitutions backed by gunmen enforced another paradigm. Can a non-paradigm shoulder a modern society?

    It looks like the greatest source of profit for the dispute resolution agencies would be insurance companies. Most disputes would be over relatively minor contractual matters(not involving murder or overt theft). Most of those disputes not precipitated by legislation involve at least one disputant in the middle class. The greatest source of profit for insurance companies is the middle class. So, it seems to me like the sense of justice behind this legal system would be that common to the middle class.

    Does anyone really think a company with the approval rating of congress could compete in a market?

    I think the idea of a stateless system is being put forward without a mandate to keep it stateless.

    Such a proposal won't stand a chance because someone will use the sensibility that we could be more organized as a society and endeavor to lead or follow a state.

    If there's some kind of law against starting up a state, what entity will enforce it? Will that present a paradox to statelessness?

    Yes, and then if poor people can't afford rape and murder insurance, they just get screwed when they get victimized.

    I don't know how a murder victim can get screwed any further, but I just described a scenario where the family of a poor murder victim with no insurance gets recompense payment from the murderer whether he can afford it at the time or not.

    What does a rape victim get under a state? She gets to pay taxes so that her rapist can be housed for a while at no expense to him.

    But that scenario has some big glaring holes in it. Why would a law enforcement corporation provide services to someone who had no insurance coverage?

    Do medical insurance companies regularly cover people who have no policy with them?

    Apparently freedom has no value to you because you don't believe losing it is a punishment.
