    No, it applies when he violates and disregards the Constitution, rewrites laws, ignores the language in laws, etc.

    His appointment was George W. Bush's biggest mistake.

    Per the ruling:

    2. The Enumeration Clause permits Congress, and by extension
    the Secretary, to inquire about citizenship on the census questionnaire.
    That conclusion follows from Congress’s broad authority over
    the census, as informed by long and consistent historical practice
    that “has been open, widespread, and unchallenged since the early
    days of the Republic.”

    That is, the question, in and of itself, does not violate the constitution.

    And so, the Commerce Department --can-- ask about citizenship, so long as the requirements of the
    Administrative Procedure Act are met.

    The SCOTUS has so little impact on our lives. That's why Democrats waived Brett Kavanaugh's nomination through instead of behaving like it was the end of the world.

    It shouldn't have to be "justified" it's a no brainer to include it. Roberts said in his ruling the question being on the survey is not unconstitutional.

    We do, this wouldn't change that. Those are domiciled legal residents not people here illegally which means temporarily as soon as we catch them.

    Should tourist be counted? At the extreme end I read a essay by a political professor who noted what if an invading army occupied south Florida, would they be counted. What about foreign students going to college here? Domiciled permanent legal residents should be counted ESPECIALLY for purposes of apportionment.
