Ted Cruz Has a Plan to Block Biden From Reentering Paris, Iran Deals but He Needs Assist from Trump

    .....In the waning days of the Trump administration, Sen. Ted Cruz has quietly been urging the president to submit both the Iran nuclear deal and the Paris climate agreement to the Senate for ratification. But not because they would succeed; rather, because they would inevitably fail.

    The equivalent of a constitutional tripwire, Cruz’s gambit would force a showdown between the Senate and President-elect Joe Biden. President Trump pulled out of the agreements; Biden has promised to recommit the United States to both without congressional approval. In a letter obtained by RealClearPolitics, the Texas senator is pressing both the president and Secretary of State Mike Pompeo to submit the pacts before Trump leaves office.

    “Your administration has rightly changed course as a matter of substantive policy by withdrawing from both the Iran Deal and the Paris Agreement. This was a great accomplishment for the American people,” Cruz wrote......







    “I urge you now also to remedy the harm done to the balance of powers by submitting the Iran Deal and the Paris Agreement to the Senate as treaties,”

    This is a must do. It’s a great idea. These items should be treaties if they are legally binding upon the USA and the senate should have a say. Treaties require a 2/3rds vote to pass. Biden woukd have a difficult time trying to issue an executive after senate rejection.

    Why officially join the Paris deal when we are already beating the numbers it would have had us achieve? The answer is that progressive greens don’t like how we did it and would rather compel us to do it a stupid expensive way instead that benefits China.

    Okay, in a few words, why can't McConnell do this after Biden is sworn in? Why is Trump's participation required, and how would any of this preclude an executive order?

    It's extremely iffy that the congress could block this.

    The Court has precedence of siding with the president because the Constitution is very clear.

    Congress could shut down the payments but as far as what we agree to it isn't up to them.

    They would literally have to pass legislation that went against what the president is doing and that would definitely land in court.

    I will look up some relevant cases later because I know there are some.
