    Jan. 6 committee tees up 20 witness transcripts for DOJ

    The Jan. 6 select committee is preparing to produce 20 witness interview transcripts to the Justice Department amid prosecutors’ increasingly public investigation of efforts by former President Donald Trump and his allies to overturn the 2020 election.

    “The Select committee intends to share 20 transcripts,” a committee spokesperson said in a late-Thursday update on the panel’s engagement with the Justice Department. “We have no plans to share additional transcripts at this time.”

    Trump DOJ official cooperating with Justice Department’s criminal Jan. 6 probe

    CNN —
    Former Justice Department staffer Ken Klukowski, who worked with Jeffrey Clark at the agency, is cooperating in the DOJ’s January 6 criminal investigation, after investigators searched and copied his electronic records several weeks ago.

    “We’ve been fully cooperating both with the Department of Justice and the Select Committee, and we’ll continue with that cooperation,” Klukowski’s lawyer Ed Greim said in a statement on Thursday.

    As I have expressed my concerns before... the committee will not hand over exculpatory evidence..... and any exculpatory evidence not handed over will be kept away from the public and never revealed as the legislative branch has this evidence in their possession and Pelosi will play the shell game with the American people and our system when it comes to the executive branch...

    In addition to a group of former President Donald Trump’s top lawyers, the Justice Department’s Jan. 6 probe is also seeking communications to and from a Republican National Committee staffer in a sensitive role.

    First Capitol Rioter to Face Trial Gets 7 Years, Longest Sentence So Far

    WASHINGTON — A federal judge on Monday sentenced Guy Wesley Reffitt, the first defendant to go on trial in the Justice Department’s sprawling criminal inquiry into the Jan. 6 attack, to more than seven years in prison, the longest sentence to date in a case stemming from the Capitol riot.

    After a nearly six-hour sentencing hearing, Judge Dabney L. Friedrich handed down a sentence at the low end of the sentencing guideline range. She noted that was still significantly longer than any given so far to any of the more than 800 people arrested in connection with the riot, many of whom have struck plea bargains.

    A jury found Mr. Reffitt guilty on five counts in March, including obstructing Congress’s certification of the 2020 presidential election and carrying a .40-caliber pistol with him during the riot. Unlike others who breached the building, Mr. Reffitt did not go inside.

    Cipollone Subpoenaed By Federal Grand Jury In Major Development In DOJ Jan. 6 Probe

    A federal grand jury investigating the events surrounding the Jan. 6 Capitol insurrection has subpoenaed former White House counsel Pat Cipollone, the New York Times, CNN and ABC News report.

    Cipollone and his legal team are reportedly expected to attempt to negotiate with the feds over the terms of the ex-White House officials’ appearance, claiming concerns about executive privilege.

    The subpoena appears to indicate that the Justice Department’s Jan. 6 probe is steadily intensifying given how deeply Cipollone was entrenched in then-President Donald Trump’s inner circle at the White House — and therefore a major witness to both Trump’s attempt to steal the 2020 election and his refusal to respond to the Capitol attack.

    DOJ Sues Navarro To Force Him To Hand Over Official WH Records On Personal Email Account

    The Justice Department filed a civil lawsuit against former Trump White House adviser Peter Navarro on Wednesday alleging that he had used “at least one non-official” ProtonMail email account while working for the White House and, in violation of the Presidential Records Act (PRA), had failed to turn over the records he’d sent and received on that account at the end of the Trump administration.

    “Mr. Navarro is wrongfully retaining Presidential records that are the property of the United States, and which constitute part of the permanent historical record of the prior administration,” the prosecutors wrote in their complaint, which was filed in the U.S. District Court for the District of Columbia.

    The prosecutors stated that the National Archives and Records Administration (NARA), the agency to which Navarro was supposed to turn over the emails, became aware of the ex-official’s ProtonMail account late last year through the investigation being held by the House’s subcommittee on the government’s COVID-19 response.

    Mastriano threatens to renege on testifying to Jan. 6 panel

    Pennsylvania GOP gubernatorial nominee Doug Mastriano is threatening to pull out of a scheduled interview with the Jan. 6 select committee, teeing up a legal fight with the panel.

    In a letter sent to the House committee on Aug. 5, Mastriano’s lawyer, Tim Parlatore, said the Republican would not testify unless Parlatore can record the session. The select panel is sure to reject that condition.

    This kangaroo court are known verified liars. They deceptively edited Trump's speech and deliberately spliced out exculpatory comments by the The President of the United States. So naturally Doug Mastriano will take those bastards right into court if they do not allow him to have his own recording of the panel’s planned interview with him.

    The panel initially agreed to let the state senator record his interview, but then these lying bastards on kangaroo J6 panel got the evil idea that if they could deceptively edit his answers, and then leak their lies, they could damage "his campaign to succeed term-limited Democratic Gov. Tom Wolf."

    So, the choice is simple for the J6 committee of known liars, Mastriano will give "the interview if he can record the discussion, or if not, the committee can pound sand."

    Democrats "like Sean Patrick Maloney, Democrat Campaign Chair, have openly admitted that the goal of the hearings you are conducting is intended to paint the Republican party as irresponsible and power hungry ahead of the midterms. For this reason, my client has legitimate concerns that your committee may attempt to" improperly "influence the outcome of the Pennsylvania state elections through the dissemination of disinformation."

    So, either allow the witness his own recording, or prepare for court.

    The Democrat for the PA governorship is currently leading by 13, so, it seems that Dems can win that race without the J6 panel cheating by deceptively editing the interview and leaking it. Given that, why not simply let him record the interview rather than whining about it?

    DOJ Rejects Eastman’s Request To Return His Seized Phone

    The Justice Department on Monday rejected conservative attorney John Eastman’s request that the DOJ return his phone, which FBI agents seized in June.

    Eastman asked a federal judge in a filing in June to order the DOJ to return his phone, eliminate records it obtained and to block investigators’ access to it after the FBI seized it. Late last month, federal prosecutors responded to Eastman’s filing, saying that they obtained a second warrant on July 12 to search the contents of his phone, which is in the hands of federal agents with the DOJ’s Office of the Inspector General. Prosecutors said the second warrant included a so-called “filter protocol” to prevent investigators from obtaining potentially privileged information from Eastman’s phone, and that Eastman’s counsel was aware of the protocol.

    In a filing on Monday, the DOJ dismissed Eastman’s challenge of the seizure of his phone — which includes Eastman’s claim that FBI agents didn’t show him the search warrant until his phone was seized. The DOJ said that Eastman’s claim lacked legal merit.

    Trump Ally Scott Perry Says FBI Seized His Phone A Day After Mar-a-Lago Raid
    Rep. Scott Perry (R-PA) told Fox News that the FBI seized his cell phone this morning. In a statement, Perry said that three FBI agents approached him while he was traveling with his family. The agents gave him a warrant and requested that he turn over his phone, Perry said.

    “They made no attempt to contact my lawyer, who would have made arrangements for them to have my phone if that was their wish. I’m outraged — though not surprised — that the FBI under the direction of Merrick Garland’s DOJ, would seize the phone of a sitting Member of Congress,” Perry said in his statement shared with Fox News.

    In 2005, he was fined and sentenced to two years of probation plus community service for unauthorized removal of classified material from the National Archives. He gave up his license to practice law.

    Yea… the very definition of communist tactics. He literally was stuffing classified documents down his shorts and walked out.

    Georgia Judge Tells Giuliani: Take A Train, Bus Or Uber, But Just Get Here Already

    A judge in Fulton County, Georgia on Tuesday rejected Rudy Giuliani’s attempt to skirt in-person testimony before a special grand jury, ordering him to travel by any other means to Atlanta. Giuliani had previously argued that a recent medical procedure bars him from flying.

    Giuliani has told prosecutors that he is unable to testify in person for an investigation into election interference in the battleground state due to the implantation of two coronary heart stents last month. Fulton County Superior Court Judge Robert McBurney swiftly rejected Giuliani’s argument on Tuesday and tentatively ordered him to appear for in-person testimony on Aug. 17.

    “Mr. Giuliani is not cleared for air travel, A-I-R,” McBurney said during a hearing on Tuesday afternoon, according to the New York Times. “John Madden drove all over the country in his big bus, from stadium to stadium.”

    DOJ Subpoenas Trump WH Lawyer Eric Herschmann In Jan. 6 Probe

    Former Trump White House lawyer Eric Herschmann has reportedly been subpoenaed for documents and testimony by a federal grand jury investigating the Jan. 6 Capitol insurrection, a person familiar with the matter told Politico.

    Although he did not work in the White House counsel’s office, Herschmann served as a senior adviser to the former president. Herschmann previously represented Trump in his first impeachment trial before later taking on the Trump White House adviser role.

    Herschmann’s experience in providing the former president with legal advice will likely lead to challenges over the scope of the subpoena. There are also questions about whether executive and attorney-client privileges may present challenges, Politico noted.

    The DOJ’s subpoena to Herschmann comes after the department subpoenaed former Trump White House lawyers Pat Cipollone and Patrick Philbin.
