Judge denies Sen. Lindsey Graham’s bid to quash subpoena in Trump election probe in Georgia

A federal judge on Monday denied Sen. Lindsey Graham’s bid to throw out a subpoena for his testimony before a special grand jury in Fulton County, Georgia, as part of its investigation into possible criminal election interference by former President Donald Trump and his allies in 2020.

The court rejected Graham’s contention that the subpoena should be quashed because of his status as a high-ranking government official, among other arguments. The subpoena requires the South Carolina Republican, who is a witness in the probe, to appear before the grand jury on Aug. 23.

District Attorney Fani Willis, who is conducting the investigation, “has shown extraordinary circumstances and a special need for Senator Graham’s testimony” about “alleged attempts to influence or disrupt” Georgia’s elections, Judge Leigh Martin May wrote in Monday’s order in U.S. District Court in South Carolina.

Aug 17 (Reuters) - Federal prosecutors examining the role of former President Donald Trump and allies in events ahead of the Jan. 6, 2021, attack on the U.S. Capitol have subpoenaed National Archives documents provided to a House of Representatives committee, the New York Times reported.

The subpoena was issued in May, sought "all materials, in whatever form" that were given to lawmakers and was signed by the prosecutor leading the Justice Department's inquiry, according to the report.

Jan. 6 Panel Members Say They’re In Talks With Pence’s Counsel About Testifying

Reps. Liz Cheney (R-WY) and Adam Schiff (D-CA), who serve on the Jan. 6 Select Committee, on Sunday said that the panel has been in discussions with former Vice President Mike Pence’s counsel about his potential testimony. Last week, Pence said he would consider testifying before the committee if he was invited to do so.

During a “Politics and Eggs” event in New Hampshire last week, Pence signaled that he has not ruled out the possibility of testifying before the committee investigating the events surrounding Jan. 6.

“If there was an invitation to participate, I would consider it,” Pence said. “I would have to reflect on the unique role that I was serving as vice president. It would be unprecedented in history for the vice president to be summoned to testify on Capitol Hill. But, as I said, I don’t want to prejudge ever any formal invitation rendered to us.”

I think Pence has the most to gain here, politically, if he is trying to distance himself from Trumpery.

Scott Perry Sues To Block DOJ From Accessing Contents Of His Cell Phone

Rep. Scott Perry (R-PA) sued to block the Justice Department from obtaining the contents of his cell phone. The FBI seized his phone earlier this month reportedly in connection with a federal investigation into attempts by several allies of former President Trump to subvert the 2020 election results.

After FBI agents seized Perry’s phone, it was placed in the custody of the DOJ’s inspector general, which has helped spearhead an inquiry into a scheme by Trump and his allies to replace department leadership as part of a fruitless attempt to steal a second term for the former president.

In his 16-page lawsuit, which was filed last week in federal court in D.C. but was not publicly docketed until late Tuesday, Perry claimed that the DOJ has not accessed records on his phone yet. He said that the department is working on obtaining a second search warrant that would inform its review, including a process to filter out potentially privileged content.

With the lawsuit Perry is attempting to block the government from searching his phone. He is also demanding that the DOJ return any data it may have acquired.

Scott has learned well from the Orange master of delay.

I understand the 1/6 committee is coming back in Sept. with a focus on how the attempted coup was funded and an emphasis on Trump's fleecing of the minions to pay for his legal defense(s) under false pretenses.

Jan. 6 Panel Mulling Another Hearing This Month

The House Jan. 6 Committee is considering holding a public hearing this month as part of its investigation into the Capitol attack, Punchbowl reports.

The committee is reportedly looking at Sept. 28 as a possible date for the hearing.

Panel members will hammer out the next steps during a retreat next Tuesday, according to Punchbowl.

There’ve been eight public committee hearings so far. The last one was held on July 21, during which the panel laid out how then-President Donald Trump did nothing to rein in the MAGA supporters that he had riled up — even as they were screaming about hanging then-Vice President Mike Pence as they ransacked the Capitol.

Looking forward to the next one.

Jan. 6 panel weighs new DOJ cooperation after Trump world subpoenas

A week after federal prosecutors bombarded Trump world with Jan. 6-related subpoenas, the chair of Congress’ Capitol attack committee said members are actively discussing how quickly to deliver its evidence trove to the Justice Department.

“We have a meeting on Friday. I plan to bring it up,” Rep. Bennie Thompson (D-Miss.) told reporters at the Capitol Tuesday, following a roughly four-hour-long meeting of the Jan. 6 select committee. “I think now that the Department of Justice is being proactive in issuing subpoenas and other things, I think it’s time for the committee to determine whether or not the information we’ve gathered can be beneficial to their investigation.”

Jan. 6 Panel Now Receiving ‘Huge’ Tranches Of Secret Service Material, Members Say

House Jan. 6 Committee chair Bennie Thompson (D-MS) and member Zoe Lofgren (D-CA) suggested on Wednesday that the panel’s made some major progress on obtaining key communication records from the Secret Service. Lofgren told MSNBC that the Secret Service has handed over a “large volume” of “very pertinent” material in response to the Jan. 6 committee’s subpoena since the panel’s last hearing in July.

“There’s texts, there’s emails, there’s radio traffic, there’s all kinds of information,” Lofgren said. “There is now a very steady flow of data coming in to the committee, and it’s a huge amount,” she added.

The California Democrat wouldn’t offer specifics on the new information the committee uncovered in the documents. However, Lofgren hinted at having “concerns” about the new material contradicting some of the testimony the committee has received.

Jan. 6 Panel Unveils Election Guardrails To Prevent Future MAGA Election Steal

The House Jan. 6 Committee on Sunday outlined its proposed reforms to the Electoral Count Act (ECA) to stop ex-President Donald Trump or anyone else from trying to overturn an election.

Committee vice chair Rep. Liz Cheney (R-WY) and committee member Rep. Zoe Lofgren (D-CA) announced in a Wall Street Journal op-ed that the panel will officially unveil its proposal this week that would “protect the rule of law and ensure that future efforts to attack the integrity of presidential elections can’t succeed.”

Then Cheney and Lofgren laid out the “four fundamental principles” of the committee’s proposed changes to the ECA.

The first principle strikes right at the heart of Trump’s election steal scheme: A reform that solidifies the vice president’s role in counting states’ electoral votes as purely ministerial, not one that has the power to hijack the process — which Trump, of course, tried to pressure then-Vice President Mike Pence to do.

One answer to the question what purpose does the committee serve.

Next Jan. 6 Panel Hearing To Be Held Next Week
House Jan. 6 Committee chair Bennie Thompson (D-MS) announced yesterday that the panel’s next hearing has been scheduled for Sept. 28 at 1 p.m. ET.

    • It’ll be the committee’s last hearing before it releases its report at the end of the year.
    • Thompson wouldn’t say what the subject of the hearing will be. However, the Democrat said the hearing will be an opportunity for the panel to use some of the “substantial footage” and “significant witness testimony” that hasn’t been revealed yet.

Ginni Thomas Agrees To Testify In Front Of Jan. 6 Committee

Hardline conservative activist Ginni Thomas, the wife of Supreme Court Justice Clarence Thomas, has agreed to give testimony in front of the House Jan. 6 Committee in the coming weeks, according to her attorney.

“I can confirm that Ginni Thomas has agreed to participate in a voluntary interview with the Committee,” Thomas’ lawyer, Mark Paoletta, said in a statement. “As she has said from the outset, Mrs. Thomas is eager to answer the Committee’s questions to clear up any misconceptions about her work relating to the 2020 election.

“She looks forward to that opportunity,” he added. The agreement comes several months after Thomas switched between hot and cold with the committee on her willingness to testify.

Vos Sues To Quash Jan. 6 Panel’s Subpoena For Testimony

Wisconsin Assembly Speaker Robin Vos (R) launched a court battle on Sunday to quash the House Jan. 6 Committee’s subpoena, which seeks his testimony on ex-President Donald Trump’s phone call to Vos pushing the state lawmaker to somehow decertify his state’s 2020 election results. Vos filed a lawsuit in the U.S. District Court for the Eastern District of Wisconsin seeking an injunction against the subpoena, which demanded that he appear for a deposition with the committee on Monday at 10 a.m. ET.

The Wisconsin Republican leader claimed in the lawsuit that the subpoena imposed an “undue burden” on him because he received it on Saturday, arguing that giving him “less than 48 hours to comply with the subpoena is completely unnecessary and unreasonable.”

Vos accused the committee of deliberately timing his requested deposition to come before the panel holds its next public hearing on Wednesday. “For reasons only known to the Committee, it believes Speaker Vos’ deposition will generate interest for its self-described made-for-TV production,” the lawsuit stated.

    https://talkingpointsmemo.com/news/vos-lawsuit-quash-jan-6-committee-subpoena

If Vos wants to avoid bad publicity he should just **** and testify. Unless testifying will produce bad publicity.

Under Oath, Ginni Thomas Stuck To Big Lie Script

MAGA activist Ginni Thomas, Supreme Court Justice Clarence Thomas’ wife, stuck to the Bie Lie even while testifying under oath in front of the House Jan. 6 Committee on Thursday, according to committee chair Bennie Thompson (D-MS). While speaking to reporters after Thomas’ four-hour voluntary interview with the panel, Thompson was asked if the far-right activist still claimed the 2020 election was stolen from ex-President Donald Trump. “Yes, she said that,” Thompson replied, per CNN.

Though the Democrat didn’t offer much detail on Thomas’ testimony, he did say she answered “some questions.”

“The information was typical of a lot of information we received from other people who were involved in this effort around Jan. 6. A lot of: ‘Well, I believed something was wrong,’” Thompson said, per Politico. “She was one of those people we wanted to talk to and, ultimately, we eventually got there.” The committee chair said the panel might include Thomas’ testimony in its next yet-to-be-scheduled public hearing “if there’s something of merit.”

Sen. Lindsey Graham loses appeals court bid to stall testimony in Trump election interference probe

A federal appeals court on Thursday rejected a request by Sen. Lindsey Graham to block a subpoena for his testimony before a Georgia grand jury investigating former President Donald Trump for election interference.

Graham, R-S.C., had asked the 11th Circuit Court of Appeals to stay an order compelling his testimony issued by a federal district judge in Georgia pending his appeal of that decision.

“Senator Graham has failed to demonstrate that he is likely to succeed on the merits of his appeal,” the 11th Circuit said in its ruling Thursday.

It's really too bad that a whole hunk of the Republican party is fine with violent insurrection and treason.

It would be so much better if they stood up for America.

There was no violent insurrection. There was an attack on our Democracy by the Speaker of the House in conjunction with the Capitol Police who refused the offer of National Guard by the President, orchestrated incitement by the Capitol Police and the FBI, and withheld damning evidence captured by the camera's in the Capitol. What was captured on camera was that John Sullivan, a radical member of the Democrat Party's militant arm, BLM & ANTIFA, was present at the Ashli Babbitt murder, despite Wray lying under oath about their presence on January 6.
It was a setup to turn a peaceful rejection of the corruption Democrats injected into our Democratic processes into a mob action by people who didn't attend the Trump rally

It saddens me to see the use of extremist sites to feed the conspiracy theories you want to believe in, that you need to believe in, in order not to deal with what the Proud Boys are and what they did. In no uncertain terms they are traitors duped in to treasonous acts by Trumpery.

The Inconvenient Truth: The Proud Boys are led by the FBI.

“The records uncovered by Reuters are startling because they show that a leader of a far-right group now under intense scrutiny by law enforcement was previously an active collaborator with criminal investigators.”
THE GUARDIAN, Proud Boys leader Enrique Tarrio was an FBI informant, Extremist leader repeatedly worked undercover for investigators after his arrest in 2012, former prosecutor and court files reveal, Aram Roston for Reuters, Wed 27 Jan 2021.

The Proud Boys were clearly a front organization of the FBI/DOJ. IOW, it was a subversive organization attempting to overthrow the elected government.

Secret police/spy agencies are always very dangerous threat to the governments they are supposed to serve.
