Harsh as the man's sentence was, it was in response to his being arrested for the third time, thereby being considered an habitual criminal. If he was arrested three times, it is a fair assumption that he committed many more than just three crimes. Either that or he is the world's most unlucky or inept criminal, being arrested every time $10. The fact that neither the owner of the purse or the victim of the mugging was injured is also neither here not there. The man committed the crimes.

Since it was a church into which he was breaking, and one which had often in the past allowed him to sleep there and fed him, he could simply have asked to once again be fed and given a place to sleep. Instead of doing that, he chose to break in. The act of breaking into a building in order to steal something is called burglary and is a crime.

Someone who has two prior arrests and who knows of California's, Three Strikes and You're Out, policy should be careful to not commit a third crime.

Despite both the author's and the OP's attempts to make the man seem the innocent victim of an unfair law system, the facts are, he committed at least three crimes, two of which involved victims who were present at the time.

The sentence may have been harsh but it wasn't arbitrary. The man earned the sentence through his continual anti-social, and in fact, criminal behavior.
