    Because...he's Don.

Failed former president Trump took to his bad copy of Twitter social media site to badmouth the judge that will be presiding over the arraignment.

Also not the little ethnic stink Trump through onto the judge's name, as if it matters his first name is Juan.

Apparently this judge presided over some hearing where Trump's convicted criminal employee was involved, and somehow that means the judge is unsuitable for Trump.

But is this not just classic Donald? Everything is always the fault of everyone else because they are biased against him, in his mind.
    https://www.independent.co.uk/news/.../trump-trial-judge-juan-merchan-b2311890.html

Donald Trump has lashed out at the judge assigned to the case against him relating to hush money payments to porn star Stormy Daniels.

Following Thursday evening’s surprise indictment of the former president — which reportedly caught him and his team off guard — Mr Trump has been angrily sharing his grievances about the situation on his social media platform, Truth Social.

On Friday morning he turned his attention to Judge Juan Merchan who will take up the case when it reaches court.

The former president posted: “The Judge ‘assigned’ to my Witch Hunt Case, a ‘Case’ that has NEVER BEEN CHARGED BEFORE, HATES ME.”

“His name is Juan Manuel Marchan [sic], was hand picked by Bragg & the Prosecutors, & is the same person who ‘railroaded’ my 75 year old former CFO, Allen Weisselberg, to take a ‘plea’ deal (Plead GUILTY, even if you are not, 90 DAYS, fight us in Court, 10 years (life!) in jail,” he wrote.

“He strong armed Allen, which a judge is not allowed to do, & treated my companies, which didn’t ‘plead’,” Mr Trump concluded, adding: “VICIOUSLY. APPEALING!”

I’m starting to compare your constant Trump threads to Stacy Abrams eating Krispy Kreme donuts, neither of you can stop.

Ok, back on topic. Now that Trump attacked the judge, that judge should recuse himself as not to appear biased by Trump’s words.

It’s almost as if Trump is a current topic.
You really think that’s how this works? Trump just keeps attacking judges and they keep recusing themselves so not to appear biased until trump gets his judge of choice? Does that not sound stupid to you?

When you take old out dated misdemeanors that normally get settled and twist them into felonies so an arrest can be made, then yeah, you’re right, they’re out to get him and interfere with an election…..again.

The judge didn’t do any of that. Remember he wanted another judge gone because he was Mexican?

Didn't have previous da passed this case up because it was stupid.

Let bread make an ass of himself and Martyr Trump in the process I think he'll get more votes because of it. Nobody except for the hard left believes any of this crap. And they don't believe it either they're just using it as a means to an end.

So sit back put your feet up pop some popcorn and watch the mainstream media just clam up about it when it inevitably doesn't go their way. Once you notice the pattern it's very predictable and quite hilarious.

So a judge MUST recuse him/herself if the defendant publicly accuses the judge of bias?

You don’t see the inherent problem with your approach?

I’m sure they’re legitimate, but I do think that they should have lead with the most important charges and indictments, those relating to his seditious crimes in Georgia and his attempts to subvert the election.
That’s where the real historical crime is.

So you think that Trump should just shut up? What makes you think that speaking about Judges should be off limits; is there a written rule somewhere that one can't? Judges don't leave their biases at the door to the courthouse. Why do you think there's so much controversy about SC nominations?

I think they were kind of waiting to see who would go first, make that leap of charging an ex-pres. We may see more charges sooner rather than later.

When you tell us what the charges are before the indictment is unsealed then you're attempting to twist what the DA has done into a "witch hunt" with no evidence.

Trump knows that is not how judges that are assigned work. But these posts by Trump will give credence for the DA to file a motion to place a gag order on the whole case. A gag order applies to both prosecution and defense. That being said, the judge assaigned for arraignment is not going to be the judge who presides over the trial. His only job is to have the defendant enter a plea, entertain certain bail and other motions by both the state and defense, and rule on them. Most of the time, it takes just a few minutes. If you get out of line, or make any type of outburst while in court, that judge has all the authority to have order and control in the courtroom.

Trump is acting like a five year old child, being told to go to his room. He is seething, pouting, and throwing a classic childish temper tantrum.

As for other lawyers, who have been in his courtroom, they all disagree as indicated in the link below.

It would be in his best interest legally, and let his lawyers do the talking for him. Most people who are charged any crime do that even though they firmly believe they are innocent, "will beat the system," or "have their day in court." Remember, anything that you say, especially in a public forum, TV, social media, etc, can be used against you if you are not careful in what you say. These types of outbursts by Trump are going to be used to put a gag order in place if Trump continues to do this sort of thing. And if he violates the gag order, then he will be fined even more, perhaps jailed, perhaps having an order in which he is not allowed to have any contact through social media. It's rare, but it is known to happen.

Right now, the first step is the arraignment. He enters a plea, bail conditions are set, and that is it. This hearing will last anywhere from 5 to 15 minutes at the most. Generally, the judge at arraignment is not the same judge who will preside over the trial.

Trump is Trump's worst enemy. I'll concede that point (if it's one you're making). A gag order will be challenged just on the basis that he's running an election and by the mere fact that it won't apply to the press. This case will be one for the appeal courts and perhaps the SC to get involved in. We're in uncharted territory.

The gag order will be solely on the case at hand. Or in other words, Trump can talk about anything and everything except the case in NY. That is it. So, it won't be challenged and succeeded. It is rare, but it can happen if the defense wants to try to poison the jury pool while going on TV. One of the most famous gag orders in place was the 2004 gag order that was placed in the Michael Jackson child molestation case.
