“We conclude that because President Trump is disqualified from holding the office of President under Section Three (of the 14th Amendment), it would be a wrongful act under the Election Code for the Secretary to list President Trump as a candidate on the presidential primary ballot,”
    -Colorado Supreme Court

I have to be honest: I was worried that this would happen. Because it HAD to happen. Any state that respects the law will have to remove Trump from the ballot. He WAS a public official. He DID engage in insurrection.

I cannot argue against this on legal grounds. But I HOPE Trump will be allowed to run. The country needs it. We need him to run and LOSE badly, if we are ever going to get rid of his fascism.

BTW, this was brought by a group of Colorado Republican and unaffiliated voters.

Colorado is a left wing establishment state. We'll have to see what the Supreme Court does with this. Will you abide by their decision?
Was insurrection ever proven? You know this was not the Civil War.

Of course! Only MAGAs think they can secede. And, I say again, even though there is NO legal argument to override Colorado's decision... I do believe it's better for the country if they do.

    Yes!

I hear what you're saying and understand why you said it. But if we are a nation guided by the rule of law he must be disqualified. Additionally, I don't think his brand of autocratic rule will go away if he is defeated in 2024 or not allowed on the ballot. That genie is out of the bottle.

it's a far right supreme court, it's good to see it for the history books, but I doubt they let it stand, even though legally he should not be on the ballot

No one has charged him with insurrection, let alone convicted him. AND Sec 3 of 14th doesnt include the President.

I have absolutely NO rational argument against that.

I know it won't go away. But if he's not defeated we'll be hearing MAGA nonsense for the rest of our lives and a horde of Republicans claiming that they, and they alone, can continue his fascist message. If he loses the elections, it will be clear that fascism can't win. If he doesn't, anybody who comes and loses will simply be "not MAGA enough" and another will come along... until one of them succeeds.

It was a four to three decision. I don't know about the ideological persuasion of the justices. But obviously this is going to be closely contested among the states. The Supreme Court, with three of the justices having been nominated by Trump, runs the risk of the legitimizing itself further if it rules in his favor.

The 14th A says NOTHING about him having to be convicted.

Of course it includes the President!

It does say they have to have committed the act/acts. How else could that be legally proven? Because NYT and CNN say so? He's being denied his right to run for office - it's gonna be a long debate.

Do you still believe the story about that cop being killed at the Capitol that day with a fire extinguisher?

Because if that's the sort of "proof" you believe to prove an "insurrection" then, you would be wrong

Humm, POTUS swears an oath to the Constitution and is elected to the "office" of the Presidency. Ho humm, this means he's "technically" an office holder, an officer.

We already have a judge making a finding that the Orange Stain participated in an Insurrection.
Now we have a court finding that he is not eligible to be on the ballot.

Full faith and credit and stare decis. The cons on the SCOTUS (minus Thomas who will have to recuse himself because of his wife) will now have to show their true colors !

You like to erase large portions of other people's post that you are responding to...... Often times to deliberately change the context.

And now you don't want other people to alter your content....

So what was the finding that the judge made?

Was he charged and convicted of insurrection?

If not then whatever finding the judge made is nothing more than a judge's opinion which will get you a cup of coffee at McDonald's if you're lucky

Yeah - you need to shove this fascistic idea of “the president is above the law” and choosing a candidate on the basis of “owning the libs” into a giant lock box, slam down the lid and jump up and down on it before burying it in a grave marked “never ever again”!

Please! For the sake of the planet please!

Does not say he has to be charged - it does however allow him to appeal through congress

No legal argument?- where in the Constitution do the qualifications to run for President say states can arbitrarily disqualify a candidate?
