No, because it's a misdemeanor, likely out of time. But it will still need to be proven for the charged crimes to remain felonies, or else he won't be able to get a conviction on anything because those would become misdemeanors too.

Your cited statute says it is a crime to promote a candidacy by illegal means. Executing a non disclosure agreement is not illegal in the least. There is no evident crime behind the mistakes (if there were mistakes) in Trump's business records. It is not easy coming up with good messaging when promoting a sham.
Yes I said that's the most interesting question I came across. But if the plan was always to illegally make those business records (agreeing to pay Cohen back in a fraudulent way) then the intent to commit the crime was established before the election.
