    Per the Constitution there is only ONE Branch of government that is supposed to be able to make laws. That is the Legislative Branch. Agencies, like the EPA are under the Executive Branch. Which means they should not be able to make regulations, which has the same effect and force as any law passed by the Legislative Branch. Which means the Executive Branch, right now, has the power to legislate. And that is not Constitutional.

    Exactly. Which is why we are working to overturn Chevron. And it actually it does more than that, it allows Agency Staff Pukes to supervise without Judicial Supervision. It's an unelected autocrats wet dream, hopefully it's about to go into the crapper.

    Justice Elena Kagan, who has warned in outside speeches of public distrust when legal rulings change simply because of new appointees, brought that emphasis to the bench on Tuesday.

    She posed a scenario involving a trade association that sues over a regulation, loses, then “10 years later … looks around and thinks: You know, the environment is more hospitable. The judges have changed. Let’s try again.”

    If you want executive agencies to be able to make law then there is an option to do that in the Constitution. Its called the Amendment Process. Look it up. We're not bound to 1776. But we are bound to the Constitution. If you don't like it, move.

    Even though I don't care for the guy I give Mitch McConnell a lot of respect for keeping that corrupt garbage Merrick Garland off the supreme Court.

    Same way I reconcile that he isn't literally Hitler or a fascist.

    These are just words people say without knowing the meaning.
