Why didn’t the Democrats try to lawfully get the judicial branch to resolve executive privilege

Why didn’t Democrat’s allow the courts to resolve this issue?

    O it’s been clear, it’s up to a court to go against Trump’s assertion. If Trump’s claim of immunity is incorrect, then a court will look at precedent and rule as such.

    everyone in the administration has said that if it the judicial branch overrules White House counsel, they will comply.

    the Democrats instead of getting the courts to do that, which according to you it’s a 100 percent locked in case, is trying to get the senate to also issue subpoenas, are they stupid?

    Then you should have no problem getting the judge to compel him. Until he's compelled, you can pound sand.

    No thank you. I would rather impeach him.
    But I'll play your game for one more round.
    Obstruction is a felony and includes jail time.
    If the Dems kick back and let it run thru the courts and Trump loses... We can lock him up for 5 years?

    It means there is always at least two legislative purposes to any subpoena'd witness or document. Those subpoenas will be enforced. Heck we still have obstruction of justice without any additional testimony, just sitting gathering dust in Schiff's desk drawer.

    If a judge finds Trump guilty of a criminal offense, then what he gets sentenced, he gets sentenced.

    I find it hilarious you’d rather impeach then get a court order to have all the witnesses you want and then impeach

    So you want to impeach without witnesses and then impeach again with witnesses huh?

    I’m sure non Democrats are gonna be thrived with Democrats bringing impeachment again on the same charges cause they didn’t have witnesses the first time.

    And yet Pelosi is holding back from sending it to the Senate. Where is your concern about the bold now? hmm? Do you support Pelosi holding onto the articles for as long as it takes to get those others to testify? Do you know that it will still have to go through the courts? And did you know that the Dems haven't even bothered taking those subpoenas to the courts which means if the Senate does they will have to start from the beginning? Meaning all that the Dems did by not bringing those to the court is that they have made the delay even longer.

    Because constitutionally the House has the "sole power of impeachment." They don't need to go to the Judiciary. And, his failure to comply and to provide documents and witnesses is one element of their Obstruction of Congress article of impeachment.

    "sole power to impeach" does not mean or imply that the House has "unlimited power".

    Far as I know all subpoenas requested are still pending in the courts.

    Yeah...it pretty much does, in regard to the impeachment process. What power don't you think they have, which they're exercising?

    So everything Congress does under impeachment is legal? Lol

    so congress had the power to do anything and everything under impeachment huh?

    They can subpoena every and anyone as long as it’s an impeachment investment?

    It's a settled issue. Subpoenaed witnesses must answer the subpoena and appear. They do NOT, however, lose their 5th amendment right, or "executive privilege," provided there is a valid reason not to answer a specific question. There is no legitimate blanket protection based on executive privilege.

    They have wide subpoena authority and it's a settled issue before the Court. What's an "impeachment investment?"

    LOL....you guys already have with Clinton.

    Clinton was not impeached for ANYTHING regarding White Water, and that was the real impetus of the Republican hunt.
