Why is cross-dressing allowed but not public nudity?

    I think that if anything, public nudity should be legal, and cross-dressing should be illegal - because nudity is a natural state of humans (and all species) - on the flip side, cross-dressing is often a sign of or promoting identity confusion as acceptable (which is an unnatural and psychologically harmful state), plus I think me or my kid witnessing a person who's so identity confused would be more upsetting and/or disturbing than (gasp) seeing another person's junk.

    So if one or the other should be illegal, it should be cross dressing not nudity - what say you?

    So much for small government conservatives, now they're looking to regulate our wardrobes /sigh :p

    So how is banning nudity small govt? We have public indecency laws - I consider cross-dressing more offensive than a nude person - so if one or the other should be banned, it should be cross-dressing

    I never said it was, I just admire the sentiment coming from the "small government" crowed wishing to add further restrictions.

    Yeah, well I go by the precedents that already exist - since it's established that public nudity is 'obscene' then I don't see why under that standard, cross dressing isn't more obscene

    Why should I have to explain to my kid that someone has a disturbing identity disorder? That's upsetting to me - I just find societies double standards stupid

    I think most people would agree that nudity is more obscene than cross-dressing. Transgenders are maybe weird, but not obscene. I would not have any issues explaining transgenderism to my child. Then there are hygienic considerations, human bodies can be pretty disgusting to view.

    I would not give a damn if both were allowed, tough.

    I live down the street from one of the old fashioned 'nudist colonies'. If you are ever curious why we have laws against these kind of these kind of things, you should visit one. Seriously, nobody wants to see that. (Usee, unsee..)

    And who gets to decide what cross dressing is - Fashions and customs have changed through history. Would you arrest a Scotsman for wearing his kilt? High heels began as mens wear for riding an combat.......... who decides what offends and what does not?

    Both should be allowed because they do not infringe upon the necessary freedoms of others - though you may require men to wear underwear so they don't sexually assault people, which is, lets face it, easier for them to do and more likely.

    Please provide medical evidence cross dressing is harmful and explain what you mean by 'unnatural'.

    That's a good point. Would his suggestion mean girls can't be tomboys? Highly subjective the idea of 'cross dressing'.

    I can agree with most of this. While some bodies are a treat to look at, some are not.
    There should be ( are ) places where one may walk about nude without giving it a second thought. I have been there and done that. But we should restrict this to areas where mutual nudity is agreed upon.
    We live in societies with certain norms and expectations, and ideally some common courtesy. Somehow, I don't see anything wrong with that.

    But since these norms are arbitrary and relative, is that not an unjustifiable basis for law?

    Imagine yourself in a restaurant, ready to have a meal, and in walks a nude, sweaty old woman, severely obese and not very clean. I'd love me that law right there.

    Well because the law should be about or based on necessary restrictions/entitlements conducive to harmonious social rights - not the imposition of values that some hold onto the lives of others.

    So what? What if a sweaty ugly fat old woman with clothes walks in? I'd be equally revolted. But why should my revulsion count for more than her desire to freely move and act in a way that does not prohibit me doing the same basic and necessary activities?

    Why should anyone care what you like?

    Sure, let people dress as they want to. I have no problem with that. And equating cross dressing to nudity is rather odd. One deals with clothes and the other doesn't.
