    If the evidence supports manslaughter I am good with that. If it supports M2 what will you have to say?

    If the Texas Rangers say manslaughter will you accept the finding of their investigation? The evidence already supports manslaughter which is why she is charged with manslaughter.

    Sentence enhancement.

    More time for her if she was, for instance, high, attempting to rob her victim, conduct a drug deal, etc.

    If it was an attempted robbery then it would be a capital murder offense and she would be facing the death penalty, that is not sentence enhancement.

    That's happened to me, too, at least once. Middle of the night our alarm goes off. In my groggy state, somehow I convinced myself that the source was a smoke detector that mistakenly thought there was smoke in the air, so there I am waving a towel at it to make it shut up when I realize that the front door is open. So here I am, naked as the day I was born, running around my front yard trying to figure out why. There was nobody there, and no sign whatsoever that anybody HAD been there. We ultimately concluded that we forgot to lock the door, and closed it JUST enough to allow the alarm to arm, but not enough to prevent a stiff gust of wind from blowing it open. It's also not the first time that I've discovered that the front door was mistakenly left unlocked overnight.

    These things happen. Probably a lot. It's just that most of the time, they end up in a "no harm, no foul" result, so they don't make the news. This just in: Some dude in Vancouver forgot to lock his front door last night, but nobody noticed. That doesn't make the news, even on a slow news day.

    Well but let's be accurate. If a murder is committed during a robbery is is automatically a first degree murder and in fact a CAPITAL murder with the death penalty That is not a sentence enhancement on a manslaughter charge. I read the Texas law and don't find anything about an enhance charge but does allow an aggravating circumstance of drug or alcohol intoxication but that is generally for vehicular homicides. Have not heard the results of her blood test.

    Actually, it was someone who came to mine. And he realized his mistake when his key didn't work, and an unknown voice (me) from inside started questioning who he was and why he was trying to get into my apartment. But his mistake was understandable, reasonable, and innocent given the layout of our complex.

    And I'm saying I don't think they will be a factor here even the drug/alcohol which applies to vehicular. She will face the 20 years under manslaughter. If a robbery is involved then flat out it is murder and capital murder.

    Will she plead mitigating circumstances? I would not be surprised in her defense but that is a different matter.

    If the evidence shows manslaughter, they are going to lay out the case. If they say its M2, will your tune change?

    They don't say, the DA is the one who decides what charges to bring. They recommend.

    That's reasonable; you're paying MUCH closer attention to this.

    I just dropped in to say what I thought & hoped to clarify something.

    Personally, 20 years seems the MINIMUM she should receive, and MUCH more if she was there for non-accidental reasons.
