Wow that DOJ is busy generating strange process crimes that magically don't seem to go against anyone who happens to agree with the President or do his bidding on political matters.

Musk has cited and noted the security concerns of the US LAW and policy he has been following for years. Musk is being sued for FOLLOWING THE LAW but DISAGREEING with Biden.

The crux of the issue is that he denied applications from people who had been granted asylum in US, and hence were legal residents with authority to work.

If SpaceX argues they were not legally able to hire non-citizens, then the question is why they were hiring green card holders, who are not citizens

 

I don't think Musk is listening to his attorneys. Second, SpaceX does hire H-1b visa holders, probaby IT positions for its company that have nothing to do specifically with building the satellites or the rocket itself. Third, ITAR regulations do say that you can hire only US Citizens and Green Card Holders with defensive technology, but it also depends on the job they are being hired to do. If they are an administrative assistant, HR assistant, custodian, or something to that accord, even an IT person for their website or internal communications systems, then any immigrant who is authorized to work in this country, including migrants and refugees, and have been approved by USCIS with an employment authorization document are entitled to the same protections as green card holders and US Citizens per Title VII of the 1964 Civil Rights Act, as amended. Specifically, it is section 188 of the Workforce Investment Act of 1998.

1. Start a company that has a government contract to allow them to launch into orbit. Every employee needs to have government security clearance to be employed. Hiring non-citizens would be an absolute breach of SpaceX contract with the US government.

He's likely telling the truth, at least before good ol' Joe came into office. Many companies that do what SpaceX does (even if just in a government contractor role) do in fact (did?) require all employees to be US Citizens, and most if not all with clean records. The reason for this is if the SHTF and we end up at war, we may lean on companies like SpaceX for military purposes, and we wouldn't want foreign nationals, especially if they happen to be from the country we are unexpectedly in a war with, to have access to their resources, knowledge, or 'stuff'. That used to be basic common sense, but a lot of things that used to be basic common sense have gone by the wayside, sadly.

 

No one is “going after” Disney. Just requiring they obey the same laws and everyone else and do t get special treatment.
