She informed him that doing so prior to a charge conference and presentation of trial defenses and evidence would be “unprecedented” and “unjust.” Sorry Jack, don’t get to demand to treat this trial differently than every other trial in America like you can in DC. This is basically her way of informing Jack that he’s a moron. Jury instructions are based on the evidence and testimony provided at the trial. Smith wanted them finalized before the trial so that he could appeal them ahead of time if he didn’t like them. Demanding the finalized instructions rather the temporary proposed instructions based on the information they have now is a non-starter and would corrupt the trial, something Jack Smith is obviously trying to do.. like he has been doing elsewhere. The reason proposed preliminary instructions were asked about on certain elements was because this is a complex case of first impression and both sides have extremely different positions on the applicable statutes and the application to the indictment. She also reminded him that the Presidential Records Act applies to the president. That’s kind of the whole point of that legislation. Jack Smith wants to live in a world where there is no PRA or any precedent because it’s very harmful to his talking points. He argued that Trump never told anyone he interviewed that he was invoking his powers or got approval from someone to do so, as if that’s required under the PRA. It’s not. The courts have already decided that and the PRA says otherwise. She put Jack Smith back in his place and made it obvious to anyone following the motions that he’s an unhinged prosecutor who is desperately trying to corrupt this process. Reality dictates a recognition of the Jan. 6 insurrection, a lack of evidence for accusations of election fraud, and that Trump's penthouse suite is not twice its actual size. It also dictates recognition of Cannon having two of her rulings overturned due to their egregious failure to follow the law. She has now walked to the water's edge of a third.

Seeing as Cannon has managed to leave the door open for the jury to consider evidence of Trump's innocence based on the PRA, a civil statute with no application to this case, it leaves Smith no choice but to force her to declare whether she thinks it does have application before the trial begins. A request he has already made and one which she denied. Then he can make a determination as to whether he should appeal to the 11th circuit to once again have her error reversed. Matters such as these have never come up when it comes to the overt incompetence of federal judges until Trump. Just one more way he has damaged the country.
