    LOL....So what? All person BORN on US soil. There are only 2 types of citizens native born (which means natural born just different wording) and Naturalized meaning you emigrated here. Thats it. There is no mysterious third citizen as you already know.....Apuzzo.

    Well, as far back as I can remember, we were all taught that a person had to have two parents who were citizens at the time of an individuals birth to make them a natural born citizen in the USA. That's the way I remember. Lord, that was over 45 years ago.

    And as you know quite well Apuzzo, there is no legal definition of the specific phrase "natural born citizen", so the definition from the 14th amendment is used.


    If you would like to change what a natural born citizen is for future elections, you should contact lawmakers to pass a legal definition of "natural born citizen" that fits your liking, otherwise I'm afraid you're SOL

    The 14th Amendment only requires that an individual be born in the United States and subject to the jurisdiction thereof to establish natural born citizenship in the United States. This matter was addressed in the Supreme Court decision in the United States v Kim Wong Ark who was declared to be a US citizen and not subject to US statutory laws. The parents of an individual don't matter unless they are foreign diplomats excluded from the jurisdiction of US statutory laws or members of an occupying military force.

    "Birthers" deny this but the SCOTUS decision and the 14th Amendment are the accepted Constitutional criteria for natural born citizenship.

    This is a false dichotomy. The issue was never that the Birther claims were racist but instead that they were being promoted predominately by racists.

    Of course Obama was born in the United States (and subject to the jurisdiction thereof) and is unquestionably a US citizen as is Rubio. John McCain is a different matter though because he was not born in the United States which is one of the two criteria required by the 14th Amendment for natural born citizenship. John McCain was granted US citizenship under statutory laws based upon the Congressional authority to create laws of natualization and a naturalized citizen is not a natural born citizen.

    After considerable amount of research, the definition of “natural born citizen” was decided on by the Supreme Court in Minor vs. Happersett. When the Court held that Virginia Minor was a citizen under Article II, Section 1, clause 5, because she was born in the US of citizen parents, that definition became national law. Therefore, Minor supersedes all other sources on this point. It is a direct Constitutional interpretation and definition.

    That's fine with me.

    Because there are millions - literally millions - of Mexicans who were born in the US to illegal alien mothers.

    Deport all of those people and their children who would automatically become illegal aliens also and you can have Rubio.

    The natural Right of Citizenship is exclusively related to the individual and is not affected by any other individual including their parents. An unalienable Right belongs to an individual without regard to any other person.

    A child born in the United States by an undocumented alien has broken no laws and is a natural born citizen of the United States based upon the 14th Amendment. Born "in the United States and subject to the laws thereof" is the only Constitutional requirement for natural born citizenship and this was established by precedent in the United States v Kim Wong Ark.

    I don't know why so many have a problem with understanding this criteria because it is so simple that even idiots should be able to understand it.

    Someone who is a “natural born citizen” does not need the 14th amendment to claim U.S. citizenship. If Wong Kim Ark had been a natural-born citizen, the Supreme Court would never have reached the 14th Amendment issue.

    Kim Wong Ark was being denied the Right of Citizenship under statutory laws which is why the Supreme Court addressed the issue of natural born citizenship as established by the 14th Amendment. The Supreme Court, in it's decision, determined that Kim Wong Ark was a natural born citizen based upon the 14th Amendment and that the statutory laws could not infringe upon his unalienable Right of Citizenship.

    Laws that violate the US Constitution are certainly an issue for the Supreme Court to address. The statutory laws were violating Kim Wong Ark's Constitutional Rights based upon the decision of the US Supreme Court.

    I think that he was also grandfathered in, since the law was passed two years after he was born. Before that he would have not been considered a natural born citizen because he was born in Panama.

    Statutory law cannot supercede an unalienable Right nor does Congress have the authority to define natural born citizenship which is established by the 14th Amendment.

    John McCain was granted "native born citizenship" under the naturalization laws passed by Congress. A native born citizen is a person who's citizenship is established at birth and not necessarily by birth. Natural born citizenship is established by birth and also at birth. John McCain's citizenship was established "at birth" and not "by birth" under statutory laws and does not meet both of the criteria established by the 14th Amendment which requires that a person be born in the United States and subject to the laws (jurisdiction) of the United States. Both criteria need to be met before a person is considered to be a natural born citizen.

    As also noted the nationality of the parents and even their legal status in the United States is not a criteria for natural born citizenship and the Right resides exclusively with the child.

    That is indeed true, and not subject to opinion, depending on which side is making the argument, or who is under discussion.
    If Rubio wants to run, he must be subjected to scrutiny. If he doesn't hold up, too bad. If he does, more power to him.

    Was he born in the United States and subject to the laws (jurisdiction) of the United States at birth? If he meets not just one but both of these criteria then he's a natural born citizen as established by the 14th Amendment.

    Natural born citizenship in the United States is based upon Jus Soli and is not based upon Jus Sanguinis under the US Constitution.

    Actually, the only people in the "media" who have started to beat this drum is the right-wing World Net Daily.

    Nobody on the left or in the real media has any doubts that Rubio is constitutionally eligible for the presidency.
