Neely was a threat and a danger to everyone around him

    You'd think a Marine would be smart enough and compassionate enough when encountering a man who is showing mental distress says he has "no food" would first try and offer him money to get something to eat.
    You know, it's called trying to defuse what could be a dicey situation.


    “I don’t have food, I don’t have a drink, I’m fed up,” Neely yelled, according to Vazquez, who posted publicly about the incident on Facebook. “I don’t mind going to jail and getting life in prison. I’m ready to die.”

    Neely didn't touch anyone or have a visible weapon.

    If Neely was "white" are you saying that Penny wouldn't have been charged with "second-degree manslaughter and criminally negligent homicide'?

    Dude this is Bragg's district. Defending yourself against violent blacks is a "hate crime" in those neck of the woods. This American hero who served our country (instead of harassing people on subways) is not going to have a just trial. He should be rewarded for helping to make the subway safer.

    Someone needs to remind Penny's lawyer Kenniff that Neeley didn't wield a weapon nor did Penny so comparing the events is beyond desperate ridiculousness.
    Harassing does not legally equate to it's okay to kill someone in return.


    "Penny's lawyers have maintained the argument that Penny acted in self-defense after Neely started harassing passengers.

    Thomas Kenniff, Penny's lawyer, compared the incident to the man who shot an unruly passenger on the subway last Thursday, telling FOX News that it was justified.

    Kenniff said prosecutors made the right call by not pursuing charges in the case."

    Penny didn't even try to defuse the situation by talking to Neeley or even asking what he could do to help him, Neeley said he was hungry and had no money.



    Penny, a Marine who claims he was scared and intimidated by an unarmed man having a mental meltdown and ends up killing him even after being warned by bystanders "you're gonna kill him" and he continued the chokehold even after Neeely stopped moving is many things and an "American hero" ain't one of them.

    A "scared and intimidated Marine"..OMG!
