A lower court can always return to Supreme Court settled issue if someone approaches them with a slightly different angle on the issue. Of course most likely the SC is going to slap down that court, but it could take a few years and meanwhile . . . .
To this day I still wonder what the Left's leadership has got on Roberts to occasionally make the Chief Justice rule against the Constitution on issues that the Left really, REALLY cares deeply about. It must be something that would be very ugly if it surfaced but still not quite damaging enough to make him rule as a Constitution hating leftist all the time.
That's the theory. Concern is tax would be higher and coverage would suffer as in Canada where you wait months or even years for medical proceedures.
I didn't say both houses of congress. The democrats now run congress and if Obamacare is ruled unconstitutional by the Supremes it will have to first be adressed there. Trump can't make law that's the domain of the legislative branch.
If the ruling is based on and conforms to constitutional law then it does. Party is irrelevant but I'm sure democrats will see it the way you do because you and they can't grasp that concept.
Then when are we going to start dealing with the illegals that are already in this country and most of them don't come from south of the border.

It’s not a Texas court, it’s a US District Court based in Texas that heard the case. They didn’t overrule the SCOTUS prior ruling, but followed their reasoning. This is a great win for freedom.
