Sheriff called parking spot shooting legal under ‘stand your ground’ laws. Prosecutors disagreed.

The sheriff is this guy's first defense witness.

 

Since I couldn't hear what was being said I don't know, but most men are very defensive of their wife/girlfriend and children.

So you think it's your place to curse out someone's wife/girlfriend that parked in a handicap spot.

no amount of foul language can justify a shove like that.

the shove was illegal, he should have gone to jail for that.

That's true. And one day I had to get my kid to stop yelling at another driver in a road rage incident because he had no idea who or what he was dealing with. He stopped screaming, he didn't push anyone and we both walked away alive.

 

I 100% wouldn't shove the guy, no matter what he was saying.

If he were cursing her out, no... that's not ok. Even then, words do not warrant an assault.

 

Of course you don't have a right to do it, when do you really have a right to put your hands on someone. We have seen these altercations since the beginning of time and yes it happens in civilized nations.

 

Yep OK to pull the weapon after being assaulted but the pulling of the trigger probably not justified so let a jury decided. I would rather have seen the attacker in jail on the felon assault and the woman fined to the max for the handicapped parking.

if you feel they are a threat, you can grab them, but not shove them.

 

So if you get into a scuffle with someone, you are now an animal. What % of the population would that be?

you have a legal right to put your hands on someone when they are a threat to you or someone else. or if you witnessed them committing a crime and you are holding them for the police.

this shove was 100% illegal and immoral.

So if you walked out the store and a man is cursing out your wife with your kids in the car what do you do?

 

If words were being exchanged the guy hardly had any time to figure out what was going on, and the shooter didn't seem like he was acting like a mad man or anything dangerous. If I was in that situation I would have defused it by getting my wife and I away from that guy or try to talk to him reasonably. Where I live, laying your hands on someone could get you killed because like they say, an armed society is a polite society.

Men have been fighting since the beginning of time. I am not saying the guy was justified in shoving the man, but men go on the defensive when they believe their family is under threat.

 

If you walk up and suddenly knock someone down who is totally unprepared to the concrete ground someone committing a felony assault your aren't?

Geez are you really going to defend this criminal and this assault too??????

 

This strikes me as a clear violation. There was no need to kill the man. He hadn't pulled a weapon. McGlockton would have been prosecuted for assault. That's how this should have ended. Just pulling the gun out would have ended it.

Armed citizens will abuse this law. There is no doubt about it. And innocent people will die.

 

Well that works both ways, what if the man would have walked up and started popping off rounds. In a polite society men don't verbally attack folk's families over a parking spot.
